After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, December 12, 2012 at 06:19 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, December 12, 2012 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. November 28, 2012

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Conveyance Plat of Lots 1-3, Block A of the Shelton Hickory Creek Addition.  The approximately 19.687 acres is located on the west side of Teasley Lane; between Hickory Creek Road to the north and Old Alton Road to the south.  The site is located within a Neighborhood Residential 6 (NR-6) zoning district.  (CV12-0003, Teasley Lane Tract, Johnna Matthews)

B. Final Plat of Lots 14-26, Block 11; Lots 1-27, Block 12; and Lots 1-22, Block 13 of the Northpointe Phase IV B Addition.  The approximately 14.269 acre site is located at the end of Hercules Lane, approximately 2,700 feet east of Nicosia; generally between Nicosia Street and Locust Street.  The site is located within a Planned Development (PD-120 North Pointe).  (FP07-0042, North Pointe Addition Ph 4, Section B, Ron Menguita)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider the approval of an Alternative Development Plan for the Denton County Juvenile Detention and Probation Facility project.  The purpose of the proposed Alternative Development Plan is to deviate from two site design standards of the Denton Development Code.  These are; Section 35.13.13.3.C.3.a.4 regarding parking in front and Section 35.13.10.C.3 regarding landscaping standards where front parking is allowed.  The subject site consists of approximately 5.66 acres and is located west of Woodrow Lane approximately 1,500 feet south of McKinney Street.  The subject site is within the Community Mixed Use General (CM-G) zoning district. 5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding a Comprehensive Plan Amendment from Employment Center Future Land Use to Neighborhood Centers on approximately 8.830 acres of land.  The subject property is generally located North of University Drive (US 380) and East of Loop 288. (CA12-0004, Spring Valley Estates, Nana Appiah)

B. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Employment Center Industrial (EC-I) to a Neighborhood Residential 6 (NR-6) zoning district on approximately 8.830 acres.  The subject property is generally located North of University Drive (US 380) and East of Loop 288. (Z12-0009, Spring Valley Estates, Nana Appiah)

C. Hold a public hearing and consider making a recommendation to City Council regarding the removal of approximately 0.48 acres of land from the Rayzor Ranch Overlay District.  The subject property is located on the north side of University Drive, approximately 1,000 feet east of IH-35E.  (Z12-0011, RaceTrac, Cindy Jackson)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
