After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, April 25, 2012 at 05:31 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction regarding amending the Denton Development Code by adding Farmer’s Market, Community Market, and Food Park as land uses in Subchapter 35.5, amending the duration of a permit for Farmer’s Markets and adding Community Markets to the list of temporary uses in Subchapter 35.12, and revising the definition of Farmer’s Market and adding new definitions of Community Market and Food Park in Subchapter 35.23.

3. Receive a report, hold a discussion, and give staff direction regarding amending Subchapter 35.12 of the Denton Development Code by revising the requirements of accessory structures.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, April 25, 2012 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. April 11, 2012

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Final Plat of Lot 3, Block 1 of the Rancho Vista Addition.  The subject property is approximately 0.622 acres in size and is located approximately 440 feet east of the southeastern intersection of University Drive (U.S. 380) and Bonnie Brae Street within the R. Beaumont Survey (A-31).  The property is located within a Community Mixed Use General (CM-G) zoning district.  (FP12-0003; Rancho Vista Addition, Lot 3, Erica Marohnic)

B. Preliminary Plat of Lot 1, Block 4 of the Rayzor Ranch South Medical Office Building. The subject property is approximately 4.095 acres in size and is generally located 1,020 at the northeast intersection of Scripture Street and I-35 Frontage Road, of within the R.R. Survey, Abstract No. 192. The property is located within a Regional Center Commercial Downtown (RCC-D) zoning district and is further restricted by the Rayzor Ranch Overlay District. C. Final plat of Mayhill Industrial Development Lot 1, Block A and Lot 1, Block B.  The approximately 5.24 acres site is located on the west side of Mayhill Road and on the north and south sides of Russell Newman Boulevard.  The property is located within an Employment Center Industrial (EC-I) zoning district. (FP12-0002, Mayhill Industrial Development, Johnna Matthews)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of a six-month extension of the General Development Plan for Windsor Oaks (GDP05-0003).  The approximately 224.5-acre site is generally located on both sides of Loop 288 north of the intersection of Loop 288 and Mingo Road.  The site is zoned Neighborhood Residential (NR-4 and NR-6), Neighborhood Residential Mixed Use-12 (NRMU-12), Community Mixed Use General (CM-G), and Employment Center-Industrial (EC-I). Commercial, office, industrial, multifamily and single family uses are proposed.  (GDPE12-0001, Windsor Oaks, Erica Marohnic) (This item was postponed from the April 11, 2012)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding the rezoning of approximately 19.87 acres from a Neighborhood Residential Mixed Use 12 (NRMU-12) and a Neighborhood Residential 6 (NR-6) zoning district and use classification to a Neighborhood Residential Mixed Use (NRMU) zoning district and use classification.  The property is located at the southwest corner of Mingo Road and Nottingham Drive. (Z11-0024, Magnolia Apartment Living, Johnna Matthews)

B. Hold a public hearing and consider making a recommendation to City Council regarding the rezoning of approximately 7.12 acres of land from Neighborhood Residential 4 (NR-4) zoning district and use classification to Community Mixed Use General (CM-G) zoning district and use classification.  The subject property is located on southeast corner of the intersection of F.M. 428 and Hartlee Field Road.  (Z12-0001, Pruett Rezoning, Cindy Jackson)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
