After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, May 9, 2012 at 05:13 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction regarding amending the Denton Development Code by adding Food Park and Commissary as land uses in Subchapter 35.5, amending the duration of a permit for Farmer’s Markets/Community Market in Subchapter 35.12, and revising the definition of Farmer’s Market/Community Market and adding new definitions of Food Park, and Commissary in Subchapter 35.23.

3. Receive a report, hold a discussion, and give staff direction regarding amending Subchapter 35.12 of the Denton Development Code by revising the requirements of accessory structures.

4. Receive a report, hold a discussion, and give staff direction concerning amending Section 35.13 of the Denton Development Code regarding Solid Waste and Recycling Facilities Design Standards.

REGULAR MEETING

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, May 9, 2012 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. April 25, 2012

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of Lots 1-3, Block A & Lots 1-4, Block B, of the Prominence Addition. The subject property is approximately 15.591 acres in size and is generally located north and south of Prominence Parkway, all east of Loop 288 within the William Lloyd Survey, Abstract No. 774. The property is located within a Planned Development zoning district (PD-191; Prominence Square). (PP12-0001, Lots 1-3, Block A & Lots 1-4, Block B, of the Prominence Addition, Erica Marohnic)

B. Conveyance Plat of Lots 1 & 4, Block A of the Hickory Creek Center Addition. The 17.946 acre site is located at the southwest corner of Hickory Creek Road and Teasley Lane (F.M. 2181) within the A. Venters Survey, Abstract No. 1315. The property is located within a Community Mixed Use General (CM-G) zoning district. (CV12-0001, Hickory Creek Center Addition, Lots 3 & 4, Block A, Erica Marohnic)

C. Final Plat of Lot 1, Block A of the Ginnings Elementary School Addition.  The approximately 9.954 acre property is located south of Sun Valley Drive, east of Stuart Road, and west of Yellow Stone Place. The property is located within a Neighborhood Residential 4 (NR-4) zoning district. (FP12-0008, Ginnings Elementary School Addition, Ron Menguita)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of a six-month extension of the General Development Plan for Windsor Oaks (GDP05-0003).  The approximately 224.5-acre site is generally located on both sides of Loop 288 north of the intersection of Loop 288 and Mingo Road.  The site is zoned Neighborhood Residential (NR-4 and NR-6), Neighborhood Residential Mixed Use-12 (NRMU-12), Community Mixed Use General (CM-G), and Employment Center-Industrial (EC-I). Commercial, office, industrial, multifamily and single family uses are proposed.  (GDPE12-0001, Windsor Oaks, Erica Marohnic) (This item was postponed from the April 25, 2012)

B. Consider approval of an Alternative Development Plan for a bank. The approximately 0.622-acre property is located south of University Drive (U.S. 380) and approximately 440 feet east of the southeastern intersection of Bonnie Brae Street and University Drive; the property is also known as Lot 3, Block 1 of the Rancho Vista Addition.  The property is located within a Community Mixed-Use General (CM-G) zoning district.  (ADP12-0003, Synergy Bank, Erica Marohnic)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider a final plat of Lots 4R, 11R and 12-R, Block F, Central Village Estates Addition, being a replat of Lots 4, 11 and 12, Block F, Central Village Estates Addition.  The three lots comprise approximately 0.324 acres.  Lot 4R is located at the northeast corner of the intersection of Nora Lane and Nora Lane and Lots 11R and 12-R are located on the west side of Pecan Tree Lane, between Central Village Drive and Nora Lane.  The property is located within a Neighborhood Residential 6 (NR-6) zoning district.  (FR12-0008, Central Village Estates, Cindy Jackson)

B. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow two Drive-through Facilities (ATMs).  The approximately 0.33 acre subject property, commonly known as Block 9 of the Old Towne Denton Addition is located north of Mulberry Street, west of Austin Street, south of Walnut Street, and east of Locust Street.  The subject property is located within the Downtown Commercial General (DC-G) zoning district. C. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow two Wind Energy Conversion Systems (WECS).  The approximately 70.6 acre subject property, commonly known as 3501 Roselawn Drive is located south of Roselawn Drive and west of the T&P Railroad right-of-way.  The subject property is located within a Neighborhood Residential 2 (NR-2) zoning district.  (S11-0005, Wind Turbines-Roselawn, Ron Menguita)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
