After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, October 10, 2012 at 05:03 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Consult with City’s attorneys regarding legal issues and strategies associated with regulating development within  the City limits and the extraterritorial jurisdiction, including limitations upon municipal regulatory authority imposed by Texas Local Government Code, Chapter 245.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, October 10, 2012 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of Lot 1-3, Block A of the MD Adkins Second Addition.  The subject property is approximately 8.010 acres in size and is generally located at the southeastern corner of Gay Drive and University Drive (US 380).  The property is located within a Commercial Mixed Use General (CM-G) zoning district.  (PP12-0008, Adkins Second Addition, Nana Appiah)

B. Final Plat of Lot 1, Block A of the MD Adkins Second Addition.  The subject property is approximately 1.364 acres in size and is generally located at the southeastern corner of Gay Drive and University Drive (US 380).  The property is located within a Commercial Mixed Use General (CM-G) zoning district.  (FP12-0016, Adkins Second Addition, Nana Appiah)

C. Final Replat of Lot 1R, Block 1 of the Vultures Row Addition; being a replat of Augies Addition, Block A, Lot 1; Nye Addition, Block 1, Lot 1; and two (2) unplatted tracts which include approximately 15 acres.  The approximate 24 acre site is located on the south side of FM2153, and is within the extraterritorial jurisdiction (ETJ) of the City of Denton.  (FR12-0010, Vultures Row, Johnna Matthews)

D. Final Plat of Lot 1R-1 and 1R-2, Block 1 of the Target Addition, being a replat of Lots 1R-1, 1R-2 and 1R-3, Block 1 of the Target Addition.  The 6.272 acre property is located northeast of the intersection of Loop 2008 and Colorado Boulevard, south of San Jacinto Boulevard and west of the DCTA Rail Line within the J.S. Taft Survey, Abstract No. 1256.  The property is located within a Regional Center Commercial Downtown (RCC-D) zoning district. (FR12-0017, Target Addition, Lots 1R-1 & 1R-2, Block 1, Erica Marohnic)

4. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding an amendment to the approved concept plan of Planned Development 120 (PD-174) to allow the development of a new church.  The subject site is located on the north side of Crawford Road and the west side of John Paine Road.  (PDA12-0001, St Mark Catholic Church, Cindy Jackson)

B. Hold a public hearing and consider making a recommendation to City Council regarding a Detailed Plan for a church and educational facility located within a Planned Development (PD-174) zoning district.  The subject site is located on the north side of Crawford Road and the west side of John Paine Road and contains an approximately 28 acres.  (PDA12-0002, St Mark Catholic Church, Cindy Jackson)

C. Hold a public hearing and consider making a recommendation to City Council regarding an amendment to the Special Sign District for the First United Methodist Church (Ord. No. 2010-016) to add a wall sign.  The approximately 4.17 acre site is located at 201 S. Locust Street between Mulberry Street and Sycamore Street and is within a Downtown Commercial General (DC-G) zoning district.  The purpose of the Special Sign District is to allow for signage to deviate from the requirements of Subchapter 15 of the Denton Development Code relating to the use of banner signs.  (SD12-0001, First United Methodist Church Sign District, Cindy Jackson)

5. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
