After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, January 9, 2013 at 06:01 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Receive a report, and hold a discussion regarding a proposed amendment to Section 35.7.6.8.D of the Denton Development Code (DDC) pertaining to standard procedures for certificate of appropriateness review.

2. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

REGULAR MEETING

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, January 9, 2013 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. December 12, 2012

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of Lot 1, Block A of the Inland Truck Parts Addition.  The subject property is approximately 7.510 acres in size and is generally located south of Elm Street, north of Loop 288 and east of Interstate 35.  The property is located in a Regional Center Commercial Downtown (RCC-D) zoning district.  (PP12-0015, Inland Truck Parts, Nana Appiah)

B. Consider approval of a six-month extension of the Preliminary Plat of Prominence Square, Phase III Addition (PP10-0005).  The subject property is approximately 58.7 acres in size and is generally located north of Prominence Parkway, west of Loop 288, south of U.S. 380 and east of Mayhill Road within the W. Lloyd Survey, Abstract No. S A-774 and MEP & PRR Company Survey, Abstract No. 1469. The property is located within a Planned Development (PD-191) zoning district. 4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of an Alternative Tree Preservation Plan (ATP) for the Woodlands Apartments. The applicant is proposing to mitigate the code required 148 tree diameter inches by preserving additional trees onsite, beyond the minimum requirement. (ATP12-0001, The Woodlands, Angie Kralik)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding an Alternative Environmentally Sensitive Area (ESA) Plan to deviate from Subchapter 35.17.8 (Riparian Buffer and Water Related Habitat Development Standards) of the Denton Development Code.  The approximately 19.87 acre property is located at the southwest corner of Mingo Road and Nottingham Drive.  The site is located within a Neighborhood Residential Mixed Use (NRMU) zoning district. (ESA12-0009, The Woodlands Alternative ESA Plan, Johnna Matthews)

B. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow a multi-family development.  The approximately 19.87 acre property is located at the southwest corner of Mingo Road and Nottingham Drive.  The site is located within a Neighborhood Residential Mixed Use (NRMU) zoning district. (S12-0004, Magnolia Apartments, Johnna Matthews)

C. Hold a public hearing and consider making a recommendation to the City Council regarding a proposed amendment to Section 35.7.6.8.D of the Denton Development Code (DDC) pertaining to standard procedures for certificate of appropriateness review.  The Historic Landmark Commission recommends approval of this request 5-0. (DCA12-0008, COA Procedures, Cindy Jackson)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
