After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, May 8, 2013 at 05:35 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, May 8, 2013 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. April 24, 2013

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of the Lot 10 of the Rancho Vista Addition. The approximately 1.7 acre property is located at the southeast corner of the intersection of W. University/Loop 288 and Bonnie Brae within the R. Beaumont Survey, Abstract No. 31.  The property is located within a Community Mixed Use General (CM-G) zoning district. (PP12-0019, Rancho Vista Addition, Cindy Jackson)

B. Preliminary plat of Lots 1-3, Block A and Lot 1, Block B of the Audra Lane Addition.  The 26.4732- acre site is located at the southwest corner of Audra Lane and Loop 288 within the MEP and PRR Co. Survey, Abstract No. 927.  The property is located within two (2) zoning districts; Neighborhood Residential Mixed Use 12 (NRMU) and Neighborhood Residential Mixed Use (NRMU). C. Final Plat of the Lot 1, Block A of St. Mark’s Catholic Church Addition. The approximately 27.9 acre property is located on the west side of John Paine Road and the north site of Crawford Road within the BBB & CRR Co Survey, Abstract No. 158.  The property is located within a Planned Development District 174 (PD-174) zoning district. D. Final plat of Lot 1, Block A of the Audra Lane Addition.  The 8.7522- acre site is located on the west side of Loop 288 and directly east of Audra Meadows, Phase 2 Subdivision, within the MEP and PRR Survey, Abstract No. 927.  The property is located within a Neighborhood Residential Mixed Use 12 (NRMU) zoning district (NRMU-12). E. Final plat of Lot 1, Block A of the Woodlands Addition.  The approximately 19.8 acre site is located at the southwest corner of Mingo Road and Nottingham Drive and is located within a Neighborhood Residential Mixed Use (NRMU) zoning district. 4. ITEMS FOR INDIVIDUAL CONSIDERATION

A. Consider a hardship variance from Subchapter 35.20.4.D (Access to Arterial Streets) of the Denton Development Code (DDC) to allow access onto Teasley Lane; a Primary Major Arterial, for a professional office building.  The approximately 10.112-acre site is located at the southwest corner of Teasley Lane and Pennsylvania Drive in a Neighborhood Residential 2 (NR-2) zoning district. 5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding a Comprehensive Plan Amendment from Existing Land Use to Community Mixed Use Centers Future Land Use on approximately 42.611 acres of land.  The subject property is generally located west of Nottingham Drive, north of Mingo Road, and south of University Drive (US 380). (CA13-0001, Denton Bible, Nana Appiah) This item will be continued to the May 22, 2013 Planning and Zoning Commission meeting.

B. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential Mixed Use (NRMU) and Neighborhood Residential 3 (NR-3) to Community Mixed Use General (CM-G) and Neighborhood Residential Mixed Use (NRMU) zoning districts on approximately 58.289 acres.  The subject property is generally located east and west of Nottingham Drive, north of Mingo Road, and south of University Drive (US 380). (Z13-0001, Denton Bible Church, Nana Appiah) This item will be continued to the May 22, 2013 Planning and Zoning Commission meeting.

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act,            respond to inquiries from the Planning and Zoning Commission or the public with specific           factual information or recitation of policy, or accept a proposal to place the matter on the           agenda for an upcoming meeting.
