After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, May 22, 2013 at 05:34 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction concerning a text amendment to Subchapter 35.5.8 of the Denton Development Code regarding Limitation (17).

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, May 22, 2013 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. May 8, 2013

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Final Plat of The Preserve at Pecan Creek, Section N, Phase 3B. The approximately 9.568 acres property is located wholly west of Lakeview Boulevard, north of Desert Willow Drive and east and west of Glen Crest Lane within the W.D. Durham Survey, Abstract No. 330 and Gideon Walker Survey, Abstract No. 1330.  The property is located within The Preserve at Pecan Creek Planned Development (PD-132) zoning district. (FP13-0005, The Preserve at Pecan Creek, Section N, Phase 3B, Erica Marohnic)

B. Final Plat of The Villages of Carmel, Phase 2A.  The approximately 6.863 acres property is located south of Bayshore Drive, west of Seaside Drive and Camino Real Trail and north of Del Rey Circle within the Gideon Walker Survey, Abstract No. 1330.  The property is located within a Neighborhood Residential 6 (NR-6) zoning district.  (FP13-0007, The Villages of Carmel, Phase 2A, Erica Marohnic)

4. PUBLIC HEARINGS:

A. Hold a public hearing and consider a Final Plat for Southridge East Addition; being a residential replat of Lot 29, Block 35, Phase 1 of the Southridge East Addition, and unplatted land situated within the J. McGowan Survey, Abstract No. 797.  The approximately 0.455 acre property is generally located on the southeast corner of Lafayette Drive and Gatewood Drive, west of Lillian B. Miller Parkway, and south of Lynhurst Lane. The property is located within a Neighborhood Residential 3 (NR-3) zoning district.  (FR13-0011, Southridge East, Mike Bell).

B. Hold a public hearing and consider making a recommendation to City Council regarding a Comprehensive Plan Amendment from Existing Land Use to Community Mixed Use Centers Future Land Use on approximately 42.611 acres of land.  The subject property is generally located west of Nottingham Drive, north of Mingo Road, and south of University Drive (US 380). (CA13-0001, Denton Bible, Nana Appiah) This item was continued from the May 8, 2013 Planning and Zoning Commission meeting.

C. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential Mixed Use (NRMU) and Neighborhood Residential 3 (NR-3) to Community Mixed Use General (CM-G) and Neighborhood Residential Mixed Use (NRMU) zoning districts on approximately 58.289 acres.  The subject property is generally located east and west of Nottingham Drive, north of Mingo Road, and south of University Drive (US 380). (Z13-0001, Denton Bible Church, Nana Appiah) This item was continued from the May 8, 2013 Planning and Zoning Commission meeting.

5. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act,            respond to inquiries from the Planning and Zoning Commission or the public with specific           factual information or recitation of policy, or accept a proposal to place the matter on the           agenda for an upcoming meeting.
