After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, November 20, 2013 at 06:02 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

1. Consult with City’s attorneys regarding legal issues and strategies associated with the Gas Well Ordinance regulations and Fire Code regulations relating to gas well drilling and production and protected uses within the City Limits and the extraterritorial jurisdiction, including Constitutional limitations, statutory limitations upon municipal regulatory authority, statutory preemption and/or impacts of federal and state law and regulations as it concerns municipal regulatory authority and matters relating to enforcement of the ordinance.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, November 20, 2013 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. November 6, 2013

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Consider a Preliminary Plat of Lot 1, Block A of the Classic Cars Addition. The subject property is approximately 10.57 acres in size and is generally located at the northeastern corner of I-35E and Shady Shores Road.  The property is located in a Regional Center Commercial Downtown (RCC-D) zoning district. (PP13-0006, Classic Cars Addition, Nana Appiah)

B. Consider a Final Plat of Lot 1, Block A of the Classic Cars Addition. The subject property is approximately 10.57 acres in size and is generally located at the northeastern corner of I-35E and Shady Shores Road. The property is located in a Regional Center Commercial Downtown (RCC-D) zoning district. (FP13-0018, Classic Cars Addition, Nana Appiah)

C. Consider a Final Replat of Lot 1 and 2, Block L of Parkview Extension Addition, being a replat of Lots 1 and 2, Block L of Parkview Extension Addition. The subject property is approximately 0.82 acres in size and is generally located at the northeastern corner of N. Bonnie Brae Road and Panhandle street. The property is located in a Neighborhood Residential Mixed Use (NRMU) zoning district. (FR13-0026, Parkview Extension, Nana Appiah)

4. PUBLIC HEARING:

A. Hold a public hearing and consider making a recommendation to the City Council regarding amendments to the City’s Gas Well Ordinance, Denton Development Code Subchapter 22, pertaining to certain definitions and permits for construction, drilling, and production activities. (DCA13-0003, Darren Groth)

5. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
