After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, March 5, 2014 at 06:02 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report and hold a discussion regarding recognition of 221 N. Elm Street, also known as City Hall West, as a State Historic Landmark.  The Historic Landmark Commission recommends City Hall West be considered for State Historic Landmark designation.

REGULAR MEETING

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, March 5, 2014 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. February 19, 2014

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Amending Preliminary Plat of 252 single-family lots and four open space lots, and 3.280 acres within Lot 1, Block 14, Villages of Carmel, Phase 1 and unplatted land. The subject property is approximately 49.296 acres in size and is generally located north of Pockrus Page Road, south of Edwards Road and east of Interstate 35 frontage road and west of Swisher Road within the Gideon Walker Survey, Abstract No. 1330. The property is located within a Neighborhood Residential 6 (NR-6) zoning district. (APP14-0001, Villages of Carmel, Phase 1B, 2B & 2D, Erica Marohnic)

B. Consider a final plat of Lot 12R, Block 9, College Addition, being a replat of part of Block 9, of the College Addition.  The 0.145 acre site is located at the southeast corner of the intersection of W. Hickory Street and Avenue A.  The property is located within a Downtown Commercial General (DC-G) zoning district.  (FR14-0001, College Addition, Cindy Jackson)

4. ITEM FOR INDIVIDUAL CONSIDERATION:

A. Consider a hardship variance to Section 35.20.4.D, (Access to arterial streets) of the Denton Development Code regarding a driveway on a Nottingham Drive, classified as a secondary arterial street.  The 2.597 acre subject property is generally located at the southeast corner of Nottingham Drive and University Drive (US HWY 380). (V13-0005, Mulkey-Mason Funeral Home Variance, Michele Berry).   

B. Consider a hardship variance to Subsection 35.20.4.D (access to arterial streets) of the Denton Development Code (DDC).  The 1.09 acre site is located at northwest corner of the intersection of W. Hickory Street and Avenue B.  The subject site is zoned Downtown Commercial General (DC-G) and Downtown Residential 2 (DR-2).  (V14-0001, CVS Pharmacy, Cindy Jackson)

C. Consider a hardship variance to Subsection 35.20.4.G (driveway separation) of the Denton Development Code (DDC).  The 1.09 acre site is located at northwest corner of the intersection of W. Hickory Street and Avenue B.  The subject site is zoned Downtown Commercial General (DC-G) and Downtown Residential 2 (DR-2).  (V14-0002, CVS Pharmacy, Cindy Jackson)

5. PUBLIC HEARING:

A. Hold a public hearing and consider making a recommendation to City Council regarding recognition of 221 N. Elm Street, also known as City Hall West, as a Recorded Texas Historic Landmark designation. The Historic Landmark Commission recommends City Hall West be considered for State Historic Landmark designation (8-0). 

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
