After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, April 9, 2014 at 05:01 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction regarding amending Subchapter 35.5.7.3 of the Denton Development Code, "General Regulations", to change the Maximum Floor Area Ratio in the Industrial Center - General zoning district from 0.4 to 2.0. 3. Receive a report, hold a discussion, and give staff direction regarding Specific Use Permit (SUP) to allow construction of a wet weather pump station and detention facility use on a property located in a Neighborhood Residential 2 (NR-2) zoning and use district on approximately 65.94 acres. The subject property is generally located west of Country Club Road and KCS Railroad, east of Fort Worth Drive, and south of Bent Oaks sub-division. After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, April 9, 2014 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Consider a Preliminary Plat of the Teasley Town Square.  The approximately 13.16 acre property is generally located on the southwest corner of the intersection of Teasley Lane (FM 2181) and Ryan Road within the Eli Pickett Survey, Abstract No. 1018.  The property is located within a Community Mixed Use General (CM-G) zoning district. B. Consider a Final Plat of the Summer Oaks Addition.  The approximately 26.67 acre property is located on the north and south sides of Paisley Drive west of Water Oaks Road and east of Mack Drive and within the M.E.P &P.R.R. Co Survey, Abstract No.s 1473, 1475, and 1503, and the T.M. Downing Survey, Abstract No 346.  The property is located within a Neighborhood Residential 4 (NR-4) zoning district. C. Consider a Final Plat of The Villages of Carmel, Phase 2D; being eight single-family detached lots.  The approximately 1.318 acres property is located north of Marina Drive, both east and west of Oceanview Drive within the Gideon Walker Survey, Abstract No. 1330.  The property is located within a Neighborhood Residential 6 (NR-6) zoning district.  (FP14-0001, The Villages of Carmel, Phase 2D, Erica Marohnic)

D. Consider a Preliminary Plat of Lots 1-18, Block A, Lots 19-35, Block B, Lots 36-55, Block C, Lots 56-63, Block D of Unit 47 of Robson Ranch Planned Development District (PD 173).  The 11.08 acre site is located east of Michelle Way and north of Robson Ranch Road. E. Consider a Final Plat of Lots 1-18, Block A, Lots 19-35, Block B, Lots 36-55, Block C, Lots 56-63, Block D of Unit 47 of Robson Ranch Planned Development District (PD 173).  The 11.08 acre site is located east of Michelle Way and north of Robson Ranch Road. 4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of a Site Plan for the Rayzor Ranch Town Center - Theater.  The subject site is the proposed Lot 20 of the Rayzor Ranch Town Center Addition, approximately 364 feet east of I-35 Frontage Road and north of the proposed Linden Drive.  The subject site within a Regional Center Commercial Downtown (RCC-D) zoning district and is further encumbered by the Rayzor Ranch Overlay District. B. Consider approval of an Alternative Tree Plan (ATP) for a residential subdivision. The approximately 45.78 acre property is located south of Ryan Road, north of Creekdale Drive, and west of Miranda Place.  The property is located within a Neighborhood Residential 4 (NR-4) zoning district with a restrictive overlay.  (ATP13-0001, Forest Meadow Phase II, Cindy Jackson)

C. Reconsider a hardship variance to Section 35.20.4.D, (access to arterial streets) of the Denton Development Code regarding a driveway on Nottingham Drive, classified as a secondary arterial street.  The 2.597 acre subject property is generally located at the southeast corner of Nottingham Drive and University Drive. The March 19, 2014 P&Z meeting vote was 3-3 resulting in this reconsideration. (V13-0005, Mulkey-Mason Funeral Home Variance, Michele Berry)

5. PUBLIC HEARING:

A. University Drive and Loop 288 within an Employment Center Industrial (EC-I) zoning district.  This item was continued from the March 19, 2014 P&Z meeting.  (ADP13-0004, Loop 288 & University, Cindy Jackson)

C. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow construction of a wet weather pump station and detention facility use on a property located in a Neighborhood Residential 2 (NR-2) zoning and use district on approximately 65.94 acres. D. Hold a public hearing and consider making a recommendation to the City Council regarding amendments to the Rayzor Ranch Overlay District (RROD) Section 35.7.15 of the Denton Development Code (DDC).  The RROD encompasses approximately 410 acres of land in its entirety and is located generally on both sides of U.S Highway 380 (West University Drive), between Interstate Highway 35 and Bonnie Brae Street. The applicant proposes to create a new sub district and allow for new uses not previously provided for within the Rayzor Ranch Overlay District.  The New Uses affect approximately 43.96 acres at the northwest corner of U.S. Highway 380 and Bonnie Brae Street within the northern tract, further described and contained wholly within Lots 1R and 3R of the Rayzor Ranch North Addition.  The RROD is further amended to allow approximately 99 acres within the southern tract located at the southeast corner of U.S. Highway 380 and Interstate Highway 35 and described as Lot 1, Block 5 Rayzor Ranch South Conveyance plat (document number 2010-119) for exemption from DDC, Section 35.18.2.A.1and 35.18.2.A.2 relative to approval of a final plat prior to release of a clearing and grading permit. The subject total acreage is located within a Regional Center Commercial Downtown (RCC-D) zoning and use district and is further encumbered by the Rayzor Ranch Overlay District.
