After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, May 21, 2014 at 05:21 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction regarding the Rayzor Ranch Overlay District (RROD).  The applicant proposes to create a new sub district to allow for new uses not previously provided for within the RROD.  The RROD is further amended to allow approximately 99 acres within the southern tract located at the southeast corner of U.S. Highway 380 and Interstate Highway 35 for exemption from DDC, Section 35.18.2.A.1 and 35.18.2.A.2 relative to approval of a final plat and construction plans prior to release of a clearing and grading permit. After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, May 21, 2014 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Consider a Conveyance Plat for Mayberry Gardens, Lots 1 and 2, Block A.  The property is generally located on the west side of Teasley Lane, approximately 2,000 feet north of Ryan Road and 1,400 feet south of Bent Oaks Circle, being 13.19 acres out of the J. Fisher Survey, Abstract No. 412 in the City of Denton, Denton County Texas.  The property is located in a Neighborhood Residential Mixed Used (NRMU) and Neighborhood Residential Mixed Use 12 zoning district (NRMU-12).  (CV14-0004, Mayberry Gardens, Michele Berry).

B. Consider a Final Plat of the Brinker Road Addition.  The approximately 20.69 acre property is generally located east of Brinker Road and north of Quail Creek Drive within the John W. Creek Survey, Abstract No. 324, and the J. White Survey, Abstract No. 1433. The property is located within Regional Center Commercial Downtown (RCC-D) and Regional Center Commercial Neighborhood (RCC-N) zoning districts. (FP14-0002, Brinker Road Addition, Mike Bell)

C. Consider a Final Plat of the Teasley Town Square.  The approximately 13.16 acre property is generally located on the southwest corner of the intersection of Teasley Lane (FM 2181) and Ryan Road within the Eli Pickett Survey, Abstract No. 1018.  The property is located within a Community Mixed Use General (CM-G) zoning district. 4. PUBLIC HEARING:

A. Continue a public hearing and consider making a recommendation to City Council regarding amendments to the Rayzor Ranch Overlay District (RROD) Section 35.7.15 of the Denton Development Code (DDC).  The RROD encompasses approximately 410 acres of land in its entirety and is located generally on both sides of U.S Highway 380 (West University Drive), between Interstate Highway 35 and Bonnie Brae Street. The applicant proposes to create a new sub district to allow for new uses not previously provided for within the Rayzor Ranch Overlay District.  The New Uses affect approximately 43.96 acres at the northwest corner of U.S. Highway 380 and Bonnie Brae Street within the northern tract, further described and contained wholly within Lots 1R and 3R of the Rayzor Ranch North Addition.  The RROD is further amended to allow approximately 99 acres within the southern tract located at the southeast corner of U.S. Highway 380 and Interstate Highway 35 and described as Lot 1, Block 5 Rayzor Ranch South Conveyance plat (document number 2010-119) for exemption from DDC, Section 35.18.2.A.1 and 35.18.2.A.2 relative to approval of a final plat and construction plans prior to release of a clearing and grading permit. The subject total acreage is located within a Regional Center Commercial Downtown (RCC-D) zoning and use district and is further encumbered by the Rayzor Ranch Overlay District. B. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit with conditions to allow a "Kindergarten, Elementary School" use on an approximately 7.11 acre property generally located at the southeast corner of Teasley Lane and Pennsylvania Drive.  The site is located within a Neighborhood Residential 2 (NR-2) zoning district. (S14-0001, Vista Academy K-5, Mike Bell) This item will be re-noticed and will be considered on June 11, 2014.

C. Hold a public hearing and consider making a recommendation to City Council regarding rezoning of approximately 6.71 acres of land from Neighborhood Residential 4 (NR-4) zoning district to Neighborhood Residential 6 (NR-6) zoning district and Neighborhood Residential Mixed Use (NRMU) zoning district and Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district.  The subject property is located the northeast corner of the intersection of E. McKinney Street and Jannie Street.  (Z11-0018, Greenbriar Courtyard, Cindy Jackson) This item will be re-noticed and will be considered on June 11, 2014.

D. Hold a public hearing and consider a Final Replat of Lot 8R, Block C, Wylie H Barnes Addition; being a residential replat of Lots 8, 9, 10, 11, and 12, Block C, Wylie H. Barnes Addition. The 1.23 acre site is generally located west of IH 35E between Oakwood and Willowwood Street. The site is located within a Neighborhood Residential 4 (NR-4) zoning district. (FR14-0004, Wylie H. Barnes Addition, Julie Wyatt)

E. Hold a public hearing and consider a Final Replat for The Preserve at Pecan Creek, Section N, Phase 3A, Lots 103R-105R, Block 8 and Phase 3A, Lots 99R-101R, Block 8 situated within the Gideon Walker Survey, Abstract No. 1330.  The approximately 1.382 acre property is generally located north of Bishop Pine Road, east of Knoll Pines Road. The property is located within a Planned Development (PD-132) zoning district.  (FR14-0006, The Preserve at Pecan Creek, Section N, Phases 3A and 3B, Julie Wyatt).  This item will be re-noticed and will be considered on June 11, 2014.

F. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow a twenty-seven (27) unit multi-family development on approximately 2.30 acres within a Neighborhood Residential Mixed Use (NRMU) zoning district. The subject property is generally located at the southeastern corner of University Drive and Nolen Circle. (S13-0006, University Apartments, Nana Appiah)

G. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow telecommunications tower on a property located in a Rural Residential (RD-5X) zoning and use district on approximately 6.88 acres. The subject property is generally located south of McKinney Street, approximately 1700 feet west of Trinity Road. (S13-0008, Atmos Energy Tower, Nana Appiah)  This item will be re-noticed and will be considered on June 11, 2014.

5. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
