After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, July 23, 2014 at 05:47 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction regarding amending the Denton Development Code by adding Food Truck Park and Commissary as land uses in Subchapter 35.5 and adding a new definition of Food Truck Park in Subchapter 35.23. (Ron Menguita)

REGULAR MEETING

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, July 23, 2014 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Consider a Preliminary Plat of the Mayberry Garden Addition. The approximately 4.66 acre property is generally located on the west side of Teasley Lane, north of Ranchman Blvd within the J. Fisher Survey, Abstract No. 421 in the City of Denton, Texas. The property is located within both Neighborhood Residential Mixed Use and Neighborhood Residential Mixed Use 12 zoning districts. B. Consider a Final Plat of the Mayberry Garden Addition. The approximately 4.66 acre property is generally located on the west side of Teasley Lane, north of Ranchman Blvd within the J. Fisher Survey, Abstract No. 421 in the City of Denton, Texas. The property is located within both Neighborhood Residential Mixed Use and Neighborhood Residential Mixed Use 12 zoning districts. C. Consider a Preliminary Plat of the McKamy Evers Estates, Phase 2.  The approximately 37.88 acre property is generally located southwest of the intersection of N Locust Street and Hercules Lane within the B.B.B. & C.R.R. Survey, Abstract No. 186.  The property is located within a Neighborhood Residential 6 (NR-6) zoning district. (PP14-0007, McKamy Evers Estates Phase 2, Mike Bell)

D. Consider a Final Plat of the Villages of Carmel, Phase 2C.  The approximately 17.76 acre property is generally located on the south side of Edwards Rd, approximately 1,650 feet west of Swisher Rd. and within the Gideon Walker Survey, Abstract No. 1330.  The property is located within a Neighborhood Residential 6 (NR-6) zoning district. E. Consider a Final Replat of the Lot 2R, Block A of the Mid States Realty Subdivision.  The approximately 5.13 acre property is generally located on west side of S Loop 288, approximately 900 feet north of Spencer Road and within the Mary L. Austin Survey, Abstract No. 4.  The property is located within a Regional Center Commercial Neighborhood (RCC-N) zoning district. (FR13-0016, Tractor Supply, Mike Bell)

F. Consider a Conveyance Plat of Lot 2, Block A of the Timber Apartments Addition.  The approximately 2.18 acre property is generally located on the east side of Ruddell Street, approximately 975 feet south of E University Drive (U.S. 380) and within the WM. Crenshaw Survey, Abstract No. 318.  The property is located within a Downtown Residential 2 (DR-2) zoning district. (CV14-0006, Timber Apartments, Mike Bell)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider the approval of an amendment to an approved Alternative Development Plan to remove a lot from an approved ADP and develop an office complex.  The 1.625 acres subject site is located at the southeast corner of the intersection of Shoreline Drive, and Wind River Lane.  The property is located within a Regional Center Commercial Downtown (RCC-D) zoning district.  (ADP14-0003, Unicorn Lake, Cindy Jackson)

B. Consider approval of an Alternative Tree Plan (ATP) for the construction of a 14, 040 square feet Community Service (Fire Station) building. The approximately 4.9 acre property is located at the northeastern corner of McKinney Street and Mockingbird Lane. The property is located in a Neighborhood Residential Mixed Use (NRMU) zoning district. (ATP14-0001, Denton Fire Station 2, Nana Appiah)

5. PUBLIC HEARING:

A. Hold a public hearing and consider making a recommendation to City Council regarding a change in future land use designation of approximately 2.38 acres from "Existing Land Use" to "Employment Centers."  The subject property is generally located on the south side of Morse Street, approximately 200 feet west of Woodrow Lane and 425 east of Baldwin Street.  The site is located within a Neighborhood Residential 4 (NR-4) zoning district. (CA14-0001, Marshall Property, Mike Bell)

B. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning of approximately 2.38 acres from Neighborhood Residential 4 (NR-4) to Employment Center Industrial (EC-I).  The subject property is generally located on the south side of Morse Street, approximately 200 feet west of Woodrow Lane and 425 east of Baldwin Street.  The site is located within a Neighborhood Residential 4 (NR-4) zoning district.  (Z14-0004, Marshall Property, Mike Bell)

C. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning of two tracts totaling approximately 131.7 acres from Employment Center Commercial (EC-C) to Industrial Center General (IC-G).  Tract 1 is generally located at the northwest corner of Western Boulevard and Jim Christal Road.  Tract 2 is generally located on the east side of Western Boulevard, approximately 425 south of U.S. 380 and 1,700 feet north of Jim Christal Road.  The site is located within an Employment Center Commercial (EC-C) zoning district.  (Z14-0009, Western Boulevard, Mike Bell)

D. Hold a public hearing and consider making a recommendation to City Council regarding a change in future land use designation for two tracts totaling approximately 131.7 acres from "Employment Centers" to "Industrial Centers."  Tract 1 is generally located at the northwest corner of Western Boulevard and Jim Christal Road.  Tract 2 is generally located on the east side of Western Boulevard, approximately 425 feet south of U.S. 380 and 1,700 feet north of Jim Christal Road. The site is located within an Employment Center Commercial (EC-C) zoning district. (CA14-0002, Western Boulevard, Mike Bell)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
