A. Consult with and provide direction to City’s attorneys regarding legal issues and strategies associated with Gas Well Ordinance regulation of gas well drilling and production within the City Limits and the extraterritorial jurisdiction, including: Constitutional limitations; statutory limitations upon municipal regulatory authority; statutory preemption; impacts of federal and state law and regulations; moratorium on drilling and production; other concerns about municipal regulatory authority or matters relating to enforcement of the Gas Well Ordinance; and legal matters associated with a citizen’s initiative regarding hydraulic fracturing where a public discussion of these legal matters would conflict with the duty of the City’s attorneys under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas.

3. | CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration: |
A. Consider a Preliminary Plat for Teasley Trails, Phases III and IV. The approximately 61.57 acre property is generally located northwest corner of the intersection of Ryan Road and Teasley Lane within the J. Fisher Survey, Abstract No. 421. The property is located within a Neighborhood Residential 6 (NR-6) zoning district with overlay restrictions. (PP14-0008, Teasley Trails, Phases III and IV, Sophie Huemer)
4. | PUBLIC HEARING: |
A. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow development of sanitary landfill and heavy manufacturing use on a property located in an Industrial Center General (IC-G) zoning and use district on approximately 147.79 acres. The subject property is generally located east of Mayhill Road, and approximately 4000 feet south of McKinney Street. (S13-0007, City of Denton Landfill, Nana Appiah) This item will be continued to the October 22, 2014.
B. Hold a public hearing and consider making a recommendation to City Council regarding an application for a Historic Landmark Designation for the property located at 1108 West Congress Street. The subject site is located on the north side of Congress Street, approximately 75 feet west of the intersection of Congress Street and Fulton Street. The Historic Landmark Commission recommends approval of this request (6-0). (HL14-0007, 1108 West Congress, Cindy Jackson)
C. Hold a public hearing and consider making a recommendation to City Council regarding a proposed amendment to the detailed plan for shopping center to revise the approved sign plan. The site is located within a Planned Development (PD-142) zoning district. The 19.67 acre subject site is located at the northeast corner of the intersection of I-35 Service Road and Westgate Drive.
