Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow development of sanitary landfill and heavy manufacturing use on a property located in an Industrial Center General (IC-G) zoning and use district on approximately 149 acres. The subject property is generally located east of Mayhill Road, and approximately 4000 feet south of McKinney Street. B. Hold a public hearing and consider making a recommendation to City Council regarding approval of an update to the City of Denton's Comprehensive Plan. (CA11-0004, Comprehensive Plan, Ron Menguita) This item will be continued to the November 5, 2014 meeting.

Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential 4 (NR-4) to Community Mixed Use General (CM-G) on approximately 7.02 acres of land. Believe that mayhill to be expanded to eight lane. Future land use designation is industrial center. Indisutral center land use def provided. site plan provided with the building identified. site photos provided. staff sent out 12/200 and 60/500, 1 opposed, no other responses. DRC recommends approval with conditions. conditions listed. Cathy Samula- 1000 S MAyhill- lived there 25 years agok and have been there again or two yaers, the smell is horrible it takes your breath away. would like acopy of the site plan that was rendered. the whol ebuffer deal is new to bme havent heard of such before. the would like to opposed it. Bentley- bc of expansion houses to be removed are yo uone of the houses for that. Samula no famiyl gets abrevement from it. dont plan on moving. Joe Doy- 5956 Sherry Lane, Dallas, Texas. represent the family that owns approx 125 acres acros sthe street from the landfilll presently on the southeast corner of spencere and mayhill roa.d with the reqwuest expansion area. behind the eight ball, received no notification as a group that is a across from the site. within the 200 ft radius. the only way we found out about this at all is through one of the neighbors that told us about it, it was about a week ago. noticed ther ewas discussion between staff and landfill for over a year. back and forth 8 times, have had zero convo an emailed nana he said i could get info from that only when it was gonna be preaped which was on monday. so it was ubmitted into record. clueless about what is going on. we are against it. i think a good nieghbor would hafve contacted neighbor across the steret. when expanded before there were limitations put on it, and negotiation on he neighbors and landfill.

doy- are we not required to receive notification within 200 ft. Nana- notices were sent to property owners within 200 and 500 ft. the read boundary is the 200 ft and the blue is 500. the red was 12 property owners. i have list of those property owners that can be provided it was from the tax office. in terms of discussion with neighbors it is my understand that SW could answer. they have been discussing including purchasing the property to neighborin residents. Bentley- discussion for maybe vance about conditions put on original landfill, do those carry over to this expansion. Joe Doy- 5956 Sherry Lane, Dallas, Texas. represent the family that owns approx 125 acres acros sthe street from the landfilll presently on the southeast corner of spencere and mayhill roa.d with the reqwuest expansion area. behind the eight ball, received no notification as a group that is a across from the site. within the 200 ft radius. the only way we found out about this at all is through one of the neighbors that told us about it, it was about a week ago. noticed ther ewas discussion between staff and landfill for over a year. back and forth 8 times, have had zero convo an emailed nana he said i could get info from that only when it was gonna be preaped which was on monday. so it was ubmitted into record. clueless about what is going on. we are against it. i think a good nieghbor would hafve contacted neighbor across the steret. when expanded before there were limitations put on it, and negotiation on he neighbors and landfill.

doy- are we not required to receive notification within 200 ft. Nana- notices were sent to property owners within 200 and 500 ft. the read boundary is the 200 ft and the blue is 500. the red was 12 property owners. i have list of those property owners that can be provided it was from the tax office. in terms of discussion with neighbors it is my understand that SW could answer. they have been discussing including purchasing the property to neighborin residents. Bentley- discussion for maybe vance about conditions put on original landfill, do those carry over to this expansion. Appiah- during staff reviewing this, this 157 acres is separate sup so it is separate from two previous sups. B that makes it more vague, the original landfill might have conditions for smell and sch would ike tosee them and see i they apply to this. Appiah there was a lanscape buffer tha twas put on it. BB conditions no ton this something something, appiah type b.not sufficent that is hwy recommended type d. BB- the building woul dhave to be built on the bufer line, there is no guaranee they would buil don the buffer line. appiah if you read the condition i sayid tha teach section of the buffer should be constructed pripor tot suin its deoposting debris. BB it woul dneed to be clariied.
C. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential 4 (NR-4) to Community Mixed Use General (CM-G) on approximately 7.02 acres of land. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential Mixed Use (NRMU) and Neighborhood Residential Mixed Use 12 (NRMU-12) to Neighborhood Residential 6 (NR-6) on approximately 15.777 acres of land. The subject property is generally located on the north side of Pockrus Page Road, approximately 760 feet east of Camino Real Trail and 625 feet west of Post Oak Boulevard.
