After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, October 22, 2014 at 05:01 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

WORK SESSION

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction regarding a Denton Development Code amendment for the sale of all alcohol within corporate limits. (Sophie Huemer)

3. Receive a report and hold a discussion regarding the Denton Plan Update. (Ron Menguita)

CLOSED MEETING

Following the completion of the Work Session, the City Council will convene in a Closed Meeting to consider specific items when these items are listed below under the Closed Meeting section of this agenda. When items for consideration are not listed under the Closed Meeting section of the agenda, the City Council will not conduct a Closed Meeting and will convene at the time listed below for its regular or special called meeting. The City Council reserves the right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent with Chapter 551 of the TEXAS GOVERNMENT CODE, as amended, as set forth below.

1. Consultation with Attorneys-Under Texas Government Code Section 551.071.

A. Consult with and provide direction to City’s attorneys regarding legal issues and strategies associated with Gas Well Ordinance regulation of gas well drilling and production within the City Limits and the extraterritorial jurisdiction, including: Constitutional limitations; statutory limitations upon municipal regulatory authority; statutory preemption; impacts of federal and state law and regulations; moratorium on drilling and production; other concerns about municipal regulatory authority or matters relating to enforcement of the Gas Well Ordinance; and legal matters associated with a citizen’s initiative regarding hydraulic fracturing where a public discussion of these legal matters would conflict with the duty of the City’s attorneys under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, October 22, 2014 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. October 8, 2014

3. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Consider a Preliminary Plat of Ryan Meadows.  The approximately 75.316 acre property is generally located on the south side of Ryan Rd, approximately 1,000 feet east of Country Club Rd. and  within the J. Withers Survey, Abstract No. 1343.  The property is located within a Neighborhood Residential 3 (NR-3) zoning district. (PP14-0009, Ryan Meadows, Mike Bell)

B. Consider a Preliminary Plat of Phase One and Phase Two of Harvest Hill.  The property is approximately 60.80 acres, with 20.2 acres situated in the Daniel D. Culp Survey A-287 and 40.6 acres situated in the James Coltart Survey A-288, City of Denton, Denton County, Texas. The property is generally located north of Kings Row and south of Loop 288, within a Neighborhood Residential 3 (NR-3) zoning district and a Neighborhood Residential 4 (NR-4) zoning district. C. Consider a Final Plat of Lots 1-35 and 53-55, Block A, Lots 36-52, Block B, Lots 56-58, Block C, Lots 59-77, Block D, Lots 78-84, Block E, Lots 85-95, Block F of Unit 2-4 of Robson Ranch Planned Development District (PD 173).  The 32.45 acre site is located north of Robson Ranch Road and east of Ed Robson Boulevard. 4. PUBLIC HEARING:

A. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow development of sanitary landfill and heavy manufacturing use on a property located in an Industrial Center General (IC-G) zoning and use district on approximately 149 acres. The subject property is generally located east of Mayhill Road, and approximately 4000 feet south of McKinney Street. (S13-0007, City of Denton Landfill, Nana Appiah) This item was continued from the October 8, 2014 meeting.

B. Hold a public hearing and consider making a recommendation to City Council regarding approval of an update to the City of Denton’s Comprehensive Plan. (CA11-0004, Comprehensive Plan, Ron Menguita) This item will be continued to the November 5, 2014 meeting.

C. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential 4 (NR-4) to Community Mixed Use General (CM-G) on approximately 7.02 acres of land.  The subject property is generally located on the northwest corner of the intersection of Teasley Lane (FM 2181) and Hickory Creek Road.  (Z14-0017, Sprouts, Mike Bell)

D. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential Mixed Use (NRMU) and Neighborhood Residential Mixed Use 12 (NRMU-12) to Neighborhood Residential 6 (NR-6) on approximately 15.777 acres of land.  The subject property is generally located on the north side of Pockrus Page Road, approximately 760 feet east of Camino Real Trail and 625 feet west of Post Oak Boulevard.  (Z14-0018, Villages of Carmel Phase 4, Mike Bell)

E. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow a "Basic Utility;" a Denton Municipal Electric (DME) electrical substation, on approximately 10.07 acres of land.  The subject property is generally located on the northeast corner of Bonnie Brae Street and Riney Road.  The site is located within a Regional Center Commercial Downtown (RCC-D) zoning district. C. Hold a public hearing and consider making a recommendation to City Council regarding a rezoning from Neighborhood Residential 4 (NR-4) to Community Mixed Use General (CM-G) on approximately 7.02 acres of land.  The subject property is generally located on the northwest corner of the intersection of Teasley Lane (FM 2181) and Hickory Creek Road.  (Z14-0017, Sprouts, Mike Bell)

D.
