After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, September 2, 2015 at 04:36 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

WORK SESSION

1. Consider and appoint a member for the Planning and Zoning Commission Chair and Vice-Chair positions.

2. Clarification and discussion of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

CLOSED MEETING

Following the completion of the Work Session, the City Council will convene in a Closed Meeting to consider specific items when these items are listed below under the Closed Meeting section of this agenda. When items for consideration are not listed under the Closed Meeting section of the agenda, the City Council will not conduct a Closed Meeting and will convene at the time listed below for its regular or special called meeting. The City Council reserves the right to adjourn into a Closed Meeting on any item on its Open Meeting agenda consistent with Chapter 551 of the TEXAS GOVERNMENT CODE, as amended, as set forth below.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, September 2, 2015 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

1. PLEDGE OF ALLEGIANCE:

A. U.S. Flag

B. Texas Flag       “Honor the Texas Flag – I pledge allegiance to thee, Texas one state under God, one and indivisible.”

2. CONSENT AGENDA: Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Consider a Final Plat of The Preserve at Pecan Creek, Section P. The approximately 17.4 acre subject property is generally located on the North Side of Bishop Pine Road and Approximately 430 Feet East of Key Largo Court, within the Gideon Walker Survey, Abstract No. 1330.  The project is located within The Preserve at Pecan Creek Planned Development 132 (PD-132).  (FP15-0011, The Preserve at Pecan Creek, Section P, Julie Wyatt)

B. Consider a Final Plat of Lots 1 – 5, Block A of the Sprouts Addition.  The approximately 7.02 acre subject property is generally located at the northwest corner of Teasley Lane (FM 2181) and Hickory Creek Road within the Eli Picket Survey, Abstract No. 1018.  The property is located within a Community Mixed Use General (CM-G) zoning district.  (FP15-0024, Sprouts Addition, Mike Bell)

C. Consider a Final Plat of Teasley Trails, Phase I. The approximately 13.953 acre subject property is generally located on the West side of Teasley Lane and approximately 1700 Feet North of Ryan Road, within the C. Poullalier Survey Abstract No. 1006 and the J. Fisher Survey, Abstract No. 421.  The project is located within a Neighborhood Residential Mixed Use 12 (NRMU-12) and Neighborhood Residential 6 (NR-6) zoning district. 3. ITEM FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of an Alternative Development Plan for the construction of an 8,300 square foot restaurant and 117 impervious parking spaces.  The subject property is generally at the northwest corner of the South Interstate 35 East service road and Wind River Lane within a Regional Center Commercial Downtown (RCC-D) zoning district. 4. PUBLIC HEARINGS:

A. Hold a public hearing and consider a Final Replat of Lots 5R-1 and 5R-2, Block A of the B.F.E. Systems Addition.  The approximately 8.7 acre property is generally located on the north side of Blagg Road, approximately 910 west of Lakeview Boulevard, within the M. Forrest Survey, Abstract No. 417.  The property is located within a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district.  (FR15-0008, B.F.E. Systems Addition, Ross Culbertson)

B. Consider making a recommendation to City Council regarding amendments to the approved Concept Plan and Detail Plan of Planned Development 176 (PD-176) to depict a Child Day Care facility on approximately 1.38 acres.  The subject property is generally located on the south side of Robinson Road, approximately 220 feet east of Teasley Lane within a Planned Development 176 (PD-176) zoning district.  (PDA15-0003, Terry’s Treehouse PD Amendment, Ross Culbertson)

C. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit for a proposed Drive-Through Facility for an automated teller machine (ATM) on approximately 0.30 acres, located on the east side of South Carroll Boulevard and approximately 130 feet south of Maple Street. The subject property is located within a Downtown Commercial General (DC-G) zoning district. (S15-0008, Access Bank Texas ATM, Julie Wyatt)

5. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
