PLANNING AND ZONING COMMISSION
November 18, 2009

After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, November 18, 2009 at 06:48 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive training on the new Granicus voting system.  (Billy Matthews)

3. Receive a report, hold a discussion, and give staff direction concerning proposed amendments to the Denton Development Code, including Subchapter 13, regarding tree preservation and mitigation.  (DCA08-0006, Tree Code Amendments, Chuck Russell)

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, November 18, 2009 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

1. PLEDGE OF ALLEGIANCE:

A. U.S. Flag

B. Texas Flag "Honor the Texas Flag - I pledge allegiance to thee, Texas one state under God, one and indivisible."

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. November 4, 2009

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code.  Approval of the Consent Agenda includes staff recommendations for approval and authorizes staff to proceed.  The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of Lot 1, Block A of the BioLife Plasma Addition.  The 3.5231 acre property is located at the northeast corner of Brinker Road and Quail Creek Drive.  The property is located within a Regional Commercial Center Neighborhood (RCC-N) zoning district.  (PP09-0005, BioLife Plasma Addition, Jane Gurney)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Alternative Development Plan (ADP) for a multifamily development located north and east of the intersection of Fort Worth Drive and Interstate Highway 35E (I-35E).  The 13.57 acre site is located within a Downtown Commercial General (DC-G) zoning district.  (ADP09-0011, The Grove at Denton, Cindy Jackson)

B. Proposed 2010 Planning and Zoning Commission calendar.

5. PUBLIC HEARINGS:  Hold a public hearing and consider making a recommendation to the Denton City Council on the following items:

A. Rezoning from a Neighborhood Residential 4 (NR-4) zoning district to a Neighborhood Residential Mixed Use (NRMU) zoning district on approximately 19.858 acres.  The property is generally located east of Hinkle Drive, 960 feet north of U.S. 380 and 1,285 feet south of Headlee Street.  (Z09-0009, Denton Nursing Home, Erica Marohnic)

B. Rezoning of approximately 5.55 acres of land from a Neighborhood Residential 2 (NR-2) zoning district and Rural Residential (RD-5) zoning district to a Neighborhood Residential Mixed Use (NRMU) zoning district.  The subject property is located at the southwest corner of Teasley Lane (F.M. 2181) and Old Alton Road.  (Z06-0033, Corinth South Substation, Cindy Jackson)

C. Specific Use Permit for an electrical substation.  The approximately 5.55 acre site is also proposed to be rezoned from a Neighborhood Residential 2 (NR-2) zoning district and a Rural Residential (RD-5) zoning district to a Neighborhood Residential Mixed Use (NRMU) zoning district (Z06-0033).  The subject property is located at the southwest corner of Teasley Lane (F.M. 2181) and Old Alton Road.  (S06-0012, Corinth South Substation, Cindy Jackson)

D. Rezoning of approximately 5.2 acres of land from a Neighborhood Residential 2 (NR-2) zoning district to a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district.  The subject property is located at 4000 W. E. Rezoning of approximately 1.11 acres of land from a Neighborhood Residential 3 (NR-3) zoning district and a Neighborhood Residential 4 (NR-4) zoning district to a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district.  A portion of the site is located within the Bell Avenue Historic Conservation District.  The subject property is located at the northeast corner of N. 6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
