After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, September 22, 2010 at 06:09 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, September 22, 2010 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. September 8, 2010

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of the Diamond T Arena Addition, Block 1, Lot 1. The approximately 92.058 acre property is located on the east side of F.M. 428, approximately 650 feet north of the intersection of F.M. 428 and Long Road.  The property is located within a Rural Residential 5 (RD-5) zoning district.  (PP10-0002, Diamond T Arena Addition, Cindy Jackson)

B. Final Replat of Lots 1 & 2, Block A of the Retreat at Denton Addition.  The approximately 14.97 acres of property is located north of I-35, west of Centre Place Drive and east of Meadow Street.  The property is located within a Downtown Commercial General (DC-G) zoning district.  (FR10-0010, the Retreat at Denton Addition, Erica Marohnic)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider a variance from Sections 35.20.4.D and 35.20.4.H of the Denton Development Code regarding access to an arterial street and corner clearance standards.  The approximately 8.174 acre site is located at the southeast corner of University Drive (U.S. 380) and Bonnie Brae Road.  The property is located within a Commercial Mixed Use General (CM-G) zoning district.  (V10-0007, Rancho Vista Addition, Erica Marohnic)

B. Preliminary Plat of Lot 3, 4 and 6-10, Block 1 of the Rancho Vista Addition.  The subject property is approximately 8.174 acres in size and is generally located at the southeast corner of University Drive (U.S. 380) and Bonnie Brae Road.  The property is located within a Commercial Mixed Use General (CM-G) zoning district.  (PP10-0006, Rancho Vista Addition, Erica Marohnic)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to the City Council regarding a Detailed Plan amendment (Ordinance 2003-324) to allow for the relocation of two gas parks within the approved Detail Plan on property located within the Robson Ranch Planned Development District (PD-173).  The subject site is located south of H. Lively Road and east of Florence Road.  (PDA10-0004, Biltmore Gas Wells, Nana Appiah)

B. Hold a public hearing and consider making a recommendation to the City Council regarding an amendment to the development and transportation standards and the district boundary of Planned Development 120 (PD-120), a Planned Development zoning district.  The Planned Development district is located west of F.M. 2164/Locust Street, between Loop 288 and Beall Street and east of Nicosia, approximately 593 feet south of Loop 288.  (PDA10-0001, Gardens of Denton, Cindy Jackson)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
