PLANNING AND ZONING COMMISSION
July 28, 2010

After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, July 28, 2010 at 05:35 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

WORK SESSION

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction regarding a proposed amendment to the Denton Development Code, Sections 35.5.7.3 and 35.5.8, regarding maximum building height in the Industrial Center General (IC-G) District.  (DCA10-0005, IC-G Max Height Requirement, Cindy Jackson)

3. Consultation with Attorney - Under Texas Government Code Section 551.071.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, July 28, 2010 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

1. PLEDGE OF ALLEGIANCE:

A. U.S. Flag

B. Texas Flag "Honor the Texas Flag - I pledge allegiance to thee, Texas one state under God, one and indivisible."

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. June 9, 2010, June 23, 2010 and July 14, 2010

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of the Mayhill Industrial Development, Block A, Lots 1-8 and Block B, Lots 1-18.  The 27.8 acre site is located on the west side of Mayhill Road and north and south of Russell Newman Road.  The property is located within an Employment Center- Industrial (EC-I) zoning district.  (PP08-0010, Mayhill Industrial Development, Johnna Matthews)

B. Final Plat of the Truck Staging Area Addition, Block A, Lots 1 and 2.  The 24.48 acre property is located approximately 1,500 feet southwest of the intersection of Airport Road and the I-35W frontage road.  The property is located within an Industrial Center Employment (IC-E) zoning district. (FP10-0004, Truck Staging Area Addition, Erica Marohnic)

C. Six month extension to the Preliminary Plat of the Muir Addition (PP07-0018).  The approximately 5-acre site is located on the west side of State School Road, north of Oakmont II Subdivision, and east of Denton State School.  The property is within a Neighborhood Residential Mixed Use (NRMU) zoning district.    (PE10-0001, Muir Addition, Johnna Matthews)

D. Six month extension to the Preliminary Plat of the Villages of Carmel, Phase 1B (PP08-0007).  The 53.3573-acre site is generally located south of Edwards Road and north of Del Ray Drive in the Villages of Carmel subdivision.  The property is within a Neighborhood Residential 6 (NR-6) zoning district.  (PE10-0004, Villages of Carmel, Phase 1B, Jane Gurney)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider a variance to Subchapter 35.20.4.D of the Denton Development Code related to access to arterial streets.  The subject Denton County Administration Facility property is comprised of approximately 41.653 acres bound by Morse Street to the north, Karina Street to the south, Loop 288 to the west, and Mayhill Road to the east.  The subject site is located within an Employment Center Commercial (EC-C) zoning district.  (V10-0005, Denton County Admin Facility Phase Two, Ron Menguita)

B. Consider approval of an Alternative Development Plan (ADP) related to Buffer Requirements for a multifamily development.  The approximately 4.518-acre property is located at the southwest corner of Eagle Drive and Carroll Boulevard.  The property is within a Downtown Commercial General (DC-G) zoning district, with a restrictive overlay that pertains to fencing between the subject property and the adjacent residential properties.  (ADP10-0003, Eagle Village, Jane Gurney)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider approval of a Residential Replat of Lots 10, 11, 12B, 14B, Block B of the Paul Hamilton Addition and previously unplatted tracts as Lot 1 of the Eagle Village Addition.  The approximately 4.518-acre property is generally located at the southwest corner of Eagle Drive and Carroll Boulevard and is located within a Downtown Commercial General (DC-G) zoning district.  (FR10-0001, Eagle Village, Jane Gurney)

B. Hold a public hearing and consider approval of a Residential Replat of Lot 1 into Lots 1R and Lot 2, Block 1 of the Lake Cities Addition.  The 8.603 acre property is located north of Windsor Drive approximately 700 feet east of Hinkle Drive.  The property is located within a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district.  (FR10-0008, Lake Cities Addition, Ron Menguita)

C. Hold a public hearing and consider making a recommendation to the Denton City Council concerning approval of the Downtown Implementation Plan.  (SI10-0001, Downtown Implementation Plan, Brian Lockley/Ron Menguita)

D. Hold a public hearing and consider making a recommendation to the Denton City Council regarding an amendment to Subchapter 5 of the Denton Development Code for an increase in permitted building height in the Industrial Center General (IC-G) zoning district.  (DCA10-0005, IC-G Building Height, Cindy Jackson)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
