After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, September 8, 2010 at 05:28 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Hold a discussion and review previous Planning and Zoning Commission Minutes.  (Chuck Russell)

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, September 8, 2010 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. June 9, 2010, June 23, 2010, July 14, 2010 and July 28, 2010, August 11, 2010, August 25, 2010

3. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of an Alternative Development Plan (ADP) for a multifamily housing development.  The approximately 14.97-acre property is located north of I-35E, west of Centre Place Drive and east of Meadows Street.  The property is located within a Downtown Commercial General (DC-G) zoning district.  (ADP10-0004, Retreat at Denton, Erica Marohnic)

A. 4. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to the City Council regarding a Detailed Plan amendment (Ordinance 2003-324) to allow for the relocation of two gas parks within the approved Detail Plan on property located within the Robson Ranch Planned Development District (PD-173).  The subject site is located south of H. Lively Road and east of Florence Road.  (PDA10-0004, Biltmore Gas Wells, Nana Appiah)

B. Hold a public hearing and consider making a recommendation to the City Council regarding the rezoning of approximately 40.37 acres of land from a Neighborhood Residential 3 (NR-3) zoning district to a Neighborhood Residential 1 (NR-1) zoning district.  The approximately 40.37 acres of land is located on the west and east sides of Ector Street, between Emery Street to the north and Sena Street to the south.  (SI10-0001, Ector Street Rezoning, Johnna Matthews)

C. Hold a public hearing and consider making a recommendation to the City Council regarding a rezoning from a Neighborhood Residential 3 (NR-3) zoning district to a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district with a restrictive overlay on approximately 6.836 acres.  The property is located at the northeast corner of Glenwood Lane and East University Drive (U.S. 380).  (Z10-0007, 1411 East University Drive, Erica Marohnic)

D. Hold a public hearing and consider making a recommendation to the City Council regarding approval of a Detailed Plan to allow a public park.  The 15.378 acre property is within the Preserve Planned Development (PD 132) and is generally located south of Lakeview Boulevard and west of the existing Denton Branch Rail Trail.  (Z10-0008, Preserve at Pecan Creek-Lakeview Trail, Ron Menguita)

5. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
