After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, January 5, 2011 at 06:03 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

WORK SESSION

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Hold a discussion concerning the proposed revocation of an Alternative Development Plan ordinance (2005-112).  The subject ordinance was approved by City Council on April 5, 2005 for a 3.2 acre site within a Regional Commercial Center Downtown (RCC-D) zoning district.  The site is located at the southwest corner of Windriver Lane and Interstate Highway 35E within the Unicorn Lake development.  (ADP04-0009/ADP10-0010, Chuy’s Restaurant, Cindy Jackson)

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, January 5, 2011 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. December 8, 2010

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Conveyance Plat of Lot 1R, Block A of the Saint Emmanuel Missionary Baptist Church Addition, being a plat that supersedes in total the Conveyance Plat for Lot 1, Block A of the Saint Emmanuel Missionary Baptist Church Addition (Doc. No. 2010-81).  The 6.113 acre site is located west Duncan Street, East of Hill Street, southwest of the Rails-to Trails Corridor and approximately 240 feet north of Smith Street.  The property is located within a Neighborhood Residential 4 (NR-4) zoning district.  (CV10-0008, Saint Emmanuel Missionary Baptist Church Addition, Lot 1R, Block A, Erica Marohnic)

B. Preliminary Plat of Prominence Square, Phase III.  The subject property is approximately 58.7 acres in size and is generally located north of Prominence Parkway, west of Loop 288, south of U.S. 380 and east of Mayhill Road.  The property is located within the Prominence Square Planned Development (PD-191) zoning district.  (PP10-0005, Prominence Square, Phase III, Erica Marohnic)

C. Preliminary Plat of Lots 1-12, Block A of the Locust LP Addition.  The approximately 40.294 acre property is located at the southwest corner of Locust Street (F.M. 2164) and Loop 288.  The property is located within the North Pointe Planned Development (PD-120) zoning district.  (PP10-0010, Gardens of Denton, Jane Gurney)

D. Final Plat of Lot 1, Block A of the Locust LP Addition.  The approximately 17.887 acre property is located at the northwest corner of Locust Street (F.M. 2164) and Beall Street.  The property is located within the North Pointe Planned Development (PD-120) zoning district.  (FP10-0015, Gardens of Denton, Jane Gurney)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider a six month extension of the Preliminary Plat of Denton Regional Medical Center, Phase 3.  The approximately 47.504 acre site is generally located north of Colorado Boulevard, between Brinker Road and Mayhill Road.  The site is located within a Regional Center Commercial Neighborhood (RCC-N) zoning district.  (PE10-0005, Denton Regional, Phase 3, Blocks 1 & 2, Ron Menguita)

B. Consider the approval of an Alternative Development Plan for the development of the Denton County Administration Facility, Phase Two.  The purpose of the proposed Alternative Development Plan is to deviate from two site design standards of the Denton Development Code.  Section 35.13.13.3.C.1 regarding parking in front and Section 35.14.4.F regarding number of parking spaces.  The subject site consists of approximately 17.26 acres and is located north of Karina Street between Kimberly Drive and Mayhill Road.  (ADP10-0006, Denton County Admin Facility Phase Two, Ron Menguita)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding the rezoning of approximately 0.26 acres of land from a Neighborhood Residential 3 (NR-3) zoning district to a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district.  The property is generally located on the east side of Bonnie Brae Street and approximately 200 feet south of the intersection of Bonnie Brae Street and Emery Street.  (Z10-0012, Janke Addition, Johnna Matthews)

B. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) for a theater use in a Downtown Commercial General zoning district.  The approximately 1.27 acre site is located on the south side of Hickory Street, approximately 200 feet west of the intersection of East Hickory Street and Bell Avenue. 6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
