PLANNING AND ZONING COMMISSION

After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, January 19, 2011 at 05:30 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

WORK SESSION

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction concerning proposed amendments to Sections 35.20.3.B, 35.20.2.A.3.c, 35.23.2, 35.20.3.B.1, 35.20.3.C and 35.13.7.C of the Denton Development Code regarding estates lots and sidewalks and/or bicycle facilities.  (Ron Menguita)

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, January 19, 2011 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

1. PLEDGE OF ALLEGIANCE:

A. U.S. Flag

B. Texas Flag "Honor the Texas Flag - I pledge allegiance to thee, Texas one state under God, one and indivisible."

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. January 5, 2011

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Preliminary Plat of Lot 1, Block A of the Denton Transit Center Addition.  The subject property is approximately 2.226 acres in size and is generally located north of Sycamore Street, south of Hickory Street and east of Railroad Ave.  The property is located within a Downtown Commercial General (DC-G) zoning district.  (PP10-0001, Denton Transit Center, Ron Menguita)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider the approval of a revised Alternative Development Plan (ADP) for a multifamily development located northeast of the intersection of Fort Worth Drive and I-35E.  The 12.751 acre site is located within a Downtown Commercial General (DC-G) zoning district.  (ADP10-0008, The Grove at Denton, Cindy Jackson)

B. Consider a variance from Section 35.20.4.H.1 of the Denton Development Code regarding corner clearance standards.  The approximately 0.32-acre property is located at the northeast corner of Piping Rock Lane and Dallas Drive and is within a Neighborhood Residential 3 (NR-3) zoning district.  (V10-0009, Enlow Driveway, Jane Gurney)

A. Consider the approval of a revised Alternative Development Plan (ADP) for a multifamily development located northeast of the intersection of Fort Worth Drive and I-35E.  The 12.751 acre site is located within a Downtown Commercial General (DC-G) zoning district.  (ADP10-0008, The Grove at Denton, Cindy Jackson)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding an amendment to the Denton Towne Crossing Special Sign District for a Del Taco Restaurant monument sign.  The site is located within a Regional Commercial Center Downtown (RCC-D) zoning district southeast of the intersection of Brinker Road and South Loop 288.  The purpose of a Special Sign District is to allow signage for a development to deviate from the requirements of Subchapter 15 of the Development Code.  (SD10-0001, Del Taco, Cindy Jackson)

B. Hold a public hearing and consider making a recommendation to City Council regarding the rezoning of approximately 0.51 acres of land from a Downtown Residential 1 (DR-1) zoning district to a Downtown Residential 2 (DR-2) zoning district.  The property is generally located on the south side of Fannin Street and west of Avenue A.  (Z10-0013, Fannin Street Apartments, Johnna Matthews)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
