PLANNING AND ZONING COMMISSION
February 23, 2011

After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, February 23, 2011 at 05:08 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

WORK SESSION

1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

2. Receive a report, hold a discussion, and give staff direction concerning proposed amendments to Sections 35.13.7.C, 35.20.2.A.3.c, 35.20.3.B, 35.20.3.B.1, 35.20.3.C and 35.23.2 of the Denton Development Code regarding estates lots and sidewalks and/or bicycle facilities.  (DCA10-0008, Sidewalk Exception, Ron Menguita) Refer to Public Hearing item 5C for backup.

3. Receive a briefing and hold a discussion regarding the involuntary annexation and service plan for approximately 1,595 acres of land contained in three (3) areas located within the City of Denton’s Extraterritorial (ETJ) Jurisdiction, in accordance with Texas Local Government Code.  The proposed annexation consists of three (3) distinct areas under multiple ownerships and of an approximate total of 1,595 acres.  The 3 areas are identified and generally located as follows:

a. DH-7:  143 acres, located east and north of Teasley Lane, south of Teasley Harbor Subdivision and west of Southlake Drive;

b. DH-9:  298 acres, located north of Pockrus Page Road, north, south and northeast of Edwards Road; and

c. DH-12:  1,154 acres, located south of E. University Drive, east of N. Mayhill Road, north and south of Blagg Road, north and south of Mills Road, east and west of S. Trinity Road.

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, February 23, 2011 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. January 19, 2011

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Final Plat of Lot 1R and Lot 2, Block A of the Signature Senior Center Addition, being a replat of Lot 1, Block A of the Signature Senior Center Addition.  The approximately 7.102 acre property is located at the southeast corner of the intersection of Brinker Road and Quail Creek Drive.  The property is located within a Regional Commercial Center Neighborhood (RCC-N) zoning district.  (FR10-0016, Signature Senior Center Addition, Cindy Jackson)

B. Final Plat of Block A, Lot 3, Teasley Commons Addition.  The approximately 0.949-acre site is located on the south side of Teasley Lane, approximately 400 feet southwest of the intersection of Teasley Lane and Lillian Miller Parkway.  The subject property is located within a Neighborhood Residential Mixed Use (NRMU) zoning district.  (FP10-0021, Teasley Commons, Block A, Johnna Matthews)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of an Alternative Tree Plan (ATP) for a restaurant and retail center.  The approximately 3.214-acre property is located at the southwest corner of Windriver Lane and the I-35E.  The property is located within a Regional Commercial Center Downtown (RCC-D) zoning district.  (ATP10-0005, Chuy’s Unicorn Lake, Cindy Jackson)

B. Consider approval of an Alternative Development Plan (ADP) for a restaurant and retail center.  The approximately 3.214-acre property is located at the southwest corner of Windriver Lane and I-35E.  The property is located within a Regional Commercial Center Downtown (RCC-D) zoning district.  The purpose of the Alternative Development Plan is to provide alternatives in lieu of the requirements of Subchapter 13 of the Denton Development Code (DDC).  (ADP10-0010, Chuy’s Unicorn Lake, Cindy Jackson)

C. Consider approval of an Alternative Development Plan (ADP) for a church.  The approximately 10.1-acre property is located at located at 6060 Teasley Lane, on the west side of the Corinth South Substation.  The property is located within a Neighborhood Residential Mixed Use (NRMU) zoning district.  The purpose of the Alternative Development Plan is to provide alternatives in lieu of the requirements of Subchapter 13 of the Denton Development Code (DDC).  (ADP10-0009, Faith United Methodist Church, Cindy Jackson)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) for a telecommunications tower on property located within an Employment Center Industrial (EC-I) zoning district.  The approximately 14.9-acre property is located east of Teasley Lane and south of the DCTA railroad right-of-way.  (S10-0010, DCTA A-Train North Communication Tower, Ron Menguita)

B. Hold a public hearing and consider making a recommendation to City Council concerning proposed amendments to Sections 35.13.7.C, 35.20.2.A.3.c, 35.20.3.B, 35.20.3.B.1, 35.20.3.C and 35.23.2 of the Denton Development Code regarding estates lots and sidewalks and/or bicycle facilities.  (DCA10-0008, Sidewalk Exception, Ron Menguita)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
