After determining that a quorum is present, the Planning and Zoning Commission will convene a Work Session on Wednesday, December 7, 2011 at 06:00 PM in the City Council Work Session Room at City Hall, 215 E. McKinney Street, Denton, Texas at which time the following items will be considered:

REGULAR MEETING

NOTE: The Planning and Zoning Commission reserves the right to adjourn into a Closed Meeting on any item on its Work Session or Regular Session agendas at any time, consistent with Chapter 551 of the Texas Government Code, as amended, including without limitation, Sections 551.071-551.086 of the Texas Open Meetings Act.

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Wednesday, December 7, 2011 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. November 16, 2011

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code. Approval of the Consent Agenda includes staff recommendations for approvals and authorizes staff to proceed. The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Final plat of Plan-It Self Storage, Lot 1, Block A.  The approximately 6.074 acre site is generally located on the east side of Blake Street and approximately 400 feet south of the intersection of Russell Newman Boulevard and Blake Street.  The property is located within an Employment Center Industrial (EC-I) zoning district.  (FP11-0005, Plan-It Self Storage, Johnna Matthews)

B. Final plat of Lot 1A, Eagle Village Addition, being a replat of Lot 1, Eagle Village Addition and Lots 2-9, Block B, Paul Hamilton Addition.  The 6.814 acre site and is located west of Carroll Boulevard, east of Cleveland Street and north of Collins Street.  The property is located within a Downtown Commercial General (DC-G) zoning district.  (FR11-0019, Eagle Village Addition, Cindy Jackson)

C. Final Plat of Lot 2R, Block W of Country Lakes North Estates Phase 2; being a replat of Lot 2, Block W of County Lakes North Estates Phase 2.  The 0.230 acre site is located east of John Payne Road, North of Crawford Road, and south of Johnson Road.  The property is located in a Planned Development District (PD-174).  (FR11-0015, Lot 2 Addition of Country Lakes North Estates, Nana Appiah)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Consider approval of a revision to an Alternative Development Plan for a multifamily development located at 905 Cleveland Street.  The 6.814 acre site is located on the west side of Carroll Boulevard, the east side of Cleveland Street and south of Eagle Drive.  The property is located within a Downtown Commercial General (DC-G) zoning district with a restrictive overly.  (ADP11-0008, Eagle Village, Cindy Jackson)

B. Consider approval of a variance to Section 35.19.6.I.1.a of the Denton Development Code regarding floodway and drainage related minimum elevations.  The approximately one (1) acre site is located north of Sycamore Street between Elm Street and Locust Street and is located within a Downtown Commercial General (DC-G) zoning district.  (V11-0013, Locust Street Lofts, Ron Menguita)

5. PUBLIC HEARINGS:

A. Hold a public hearing and consider making a recommendation to City Council concerning the Update to the Pedestrian and Bicycle Linkage Component to the Mobility Plan.  (Jim Coulter, Director of Water Utilities)

B. Hold a public hearing and consider making a recommendation to City Council concerning an amendment to an Alternative Development Plan for an environmentally sensitive area (ESA) plan.  The original alternative ESA plan is located within both the 133.5 acre Unicorn Lake Development and the 31.4 acre Unicorn Lake Estates Subdivision which are located south of Interstate 35E, along both sides of Wind River Lane and both north and west of Clubhouse Drive.  The site is located within a Neighborhood Residential Mixed-Use (NRMU-12) zoning district with an overlay district, Neighborhood Residential 4 (NR-4) zoning district, and Regional Center Commercial Downtown (RCC-D) zoning district.  (ADP11-0009, Unicorn Lake ESA, Cindy Jackson)

C. Hold a public hearing and consider making a recommendation to City Council regarding a Specific Use Permit (SUP) to allow gas well drilling and production on a property located within a Neighborhood Residential Mixed Use (NRMU) zoning and use district on approximately 2.64 acres.  The subject property is generally located south of Airport Road, east of Interstate 35 West, and west of South Bonnie Brae Street. 6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
