1. Clarification of agenda items listed in the Regular Session agenda for this meeting, and discussion of issues not briefed in the written backup materials.

REGULAR MEETING

After completing the Work Session, the Planning and Zoning Commission will convene a Regular Meeting of the Planning and Zoning Commission of the City of Denton, Texas which will be held on Tuesday, May 4, 2010 and will begin at 6:30 p.m. in the City Council Chambers at City Hall, 215 E. McKinney at which time the following items will be considered:

2. CONSIDER APPROVAL OF THE PLANNING AND ZONING COMMISSION MINUTES FOR:

A. March 24, 2010

3. CONSENT AGENDA:  Staff recommends approval of the following items because they meet the requirements of the Denton Development Code.  Approval of the Consent Agenda includes staff recommendations for approval and authorizes staff to proceed.  The Planning and Zoning Commission has reviewed the applications and has had an opportunity to raise questions regarding the items prior to consideration:

A. Conveyance Plat of Lot 1, Block 5 of the Rayzor Ranch South Addition.  The 99.566 acre site is located at the southeast corner of Interstate Highway 35 (I-35) and U.S. Highway 380 (West University Drive).  The property is located within a Regional Center Commercial Downtown (RCC-D) zoning district as modified by the Rayzor Ranch Overlay District.  (CV10-0004, Lot 1, Block 5 of the Rayzor Ranch South Addition, Erica Marohnic)

4. ITEMS FOR INDIVIDUAL CONSIDERATION:

A. Six (6) month extension of the General Development Plan of Rayzor Ranch - South (GDP07-0002).  The approximately 265.64 acre site is located at the southeast corner of Interstate Highway 35 (I-35) and U.S. Highway 380 (West University Drive).  The property is located within a Regional Commercial Center Downtown (RCC-D) and a Neighborhood Residential Mixed Use (NRMU) zoning district as modified by the Rayzor Ranch Overlay District.  (GDPE10-0001, Rayzor Ranch-South, Erica Marohnic)

5. PUBLIC HEARINGS:  Hold a public hearing and consider making a recommendation to the Denton City Council on the following items:

A. Consider an application for a Historic Landmark Designation request for the property located at 322 Texas Street, and provide a recommendation regarding the appropriateness of the property to receive this designation to the City Council.  The subject property is located within a Downtown Residential 2 (DR-2) zoning district.  (HL10-0002, 322 Texas Street, Historic Landmark Designation Request, Jane Gurney)

B. Rezoning of approximately 4.678 acres of land from a Neighborhood Residential 3 (NR-3) zoning district to a Neighborhood Residential Mixed Use (NRMU) zoning district.  The property is generally located at the northeast corner of Bonnie Brae Street and West Oak Street.  (Z09-0013, Bonnie Brae Medical Park, Jane Gurney)

C. Amendment to a 3,331-acre Master Planned Community Zoning District (MPC07-0001, Hunter Ranch) to add two (2) existing gas well park sites not previously identified in the MPC; modify the location, acreages and number of gas well park sites; revise commercial and residential acreage to facilitate gas well park site changes; decrease the number of approved single-family units from 11,914 to 11,135 and decrease the number of multi-family units from 3,408 to 3,249.  The subject site is generally located on both sides of I-35W, between Robson Ranch Road and Vintage Boulevard in the City of Denton.  (AMPC10-0001, Hunter Ranch/Inspiration, Nana Appiah)

D. Rezoning of approximately 5.2 acres of land from a Neighborhood Residential 2 (NR-2) zoning district to a Neighborhood Residential Mixed Use 12 (NRMU-12) zoning district.  The subject property is located at 4000 W. University Drive (U.S. Highway 380), east of Masch Branch Road.  (Z09-0011, Girl Scouts of NE TX, Cindy Jackson)

E. Rezoning of approximately 40.35 acres of land from a Neighborhood Residential 2 (NR-2) zoning district and a Neighborhood Residential 4 (NR-4) zoning district to a Rural Residential 5 (RD-5) zoning district.  The subject property is located on the east side of F.M. 428, north of Long Road.  (Z10-0003, Diamond T Arena, Cindy Jackson)

6. FUTURE AGENDA ITEMS:  Under Section 551.042 of the Texas Open Meetings Act, respond to inquiries from the Planning and Zoning Commission or the public with specific factual information or recitation of policy, or accept a proposal to place the matter on the agenda for an upcoming meeting.
