I'LL TRY TO KEEP IT BRIEF, JUST AN OVERVIEW OF WHAT IS THE MNDO AND THEN ALLOW AN OPPORTUNITY FOR ANY QUESTIONS THAT YOU MIGHT HAVE.

SO WE'LL GO RIGHT INTO THE PRESENTATION.

SO THE ORDINANCE WAS PASSED IN MARCH OF THIS YEAR.

THE SLIDE DOES PROVIDE A LITTLE BACKGROUND AND HISTORY AND HOW WE GOT TO THAT POINT.

SO IT WAS A REQUEST FROM CITY COUNCIL ACTUALLY LAST SUMMER.

THEY WANTED TO SEE SOME RESEARCH ON OTHER CITIES THAT HAD NONDISCRIMINATION ORDINANCES.

AND THEN FROM THAT POINT, AFTER PRESENTING SOME RESEARCH, THEY ASKED US TO GO STAFF TO DRAFT AN ORDINANCE AND A PROCESS.

WE WORKED THROUGH THAT LAST FALL AND WINTER WITH CITY COUNCIL FOR A FEW WORK SESSIONS.

AND THEN LASTLY, WE GOT THE PUBLIC INPUT IN FEBRUARY OF THIS YEAR LEADING TO THE ADOPTION IN MARCH.

THE ORDINANCE IS NOT EFFECTIVE YET.

THERE WAS 120 CALENDAR DAYS DELAYED FROM WHEN IT WAS ADOPTED.

SO IT ACTUALLY BE EFFECTIVE JULY 20TH OF THIS YEAR AND THAT'S REALLY TIME TO ALLOW US TO EDUCATE AND COMMUNICATE WHAT IS THE ORDINANCE AS WELL AS ESTABLISH SOME PROCESSES THAT WE NEED TO START IMPLEMENTING.

SO WHAT IS AN NDO THIS VERY FIRST QUESTION? IT IS AN ACTION THAT SOME LOCAL GOVERNMENTS HAVE DECIDED TO DO WHEN THERE ARE NOT PROTECTIONS AT THE FEDERAL OR STATE LEVEL.

SO A LOT OF TIMES THAT IS PROTECTIONS THAT DO NOT EXIST CURRENTLY IN FEDERAL OR STATE LAW FOR SEXUAL ORIENTATION OR GENDER IDENTITY.

THERE ARE FIVE OTHER CITIES IN TEXAS THAT HAVE AN NDO ALREADY, WHICH WE'VE LOOKED AT CLOSELY.

THEY'RE LISTED ON THE SCREEN THERE YOU CAN SEE PLANO, ARLINGTON, DALLAS, FORT WORTH AND AUSTIN.

SO WHAT IS THE CITY'S NDO WHAT DOES IT COVER AND I'M SORRY, SHOULD SAY DRAFT ON THE TOP THAT IT IS APPROVED.

SO WHAT DOES THE NGO COVER?

IT COVERS THREE THINGS HOUSING, EMPLOYMENT AND PUBLIC ACCOMMODATIONS.

AND IT IS THE FOLLOWING ARE PROTECTED CLASSES OF RACE, COLOR, NATIONAL ORIGIN, AGE, RELIGION, DISABILITY, SEX, SEXUAL ORIENTATION AND GENDER IDENTITY. SO YOU CANNOT DISCRIMINATE IN THOSE THREE AREAS BASED ON THOSE LISTS OF PROTECTED CLASSES.

AND THE LANGUAGE THAT IS IN OUR LOCAL ORDINANCE GENERALLY IS THE SAME LANGUAGE THAT YOU'RE GOING TO SEE IN FEDERAL AND STATE LAW.

AND WE DID THAT VERY STRATEGICALLY SO THAT WHERE WE COULD WE CAN HELP REFER TO THE APPROPRIATE FEDERAL OR STATE AGENCY AS WELL.

SO WHAT IS NOT COVERED? WHAT MIGHT BE EXEMPTED FROM THE CITY'S MNDO? THERE ARE BROAD EXEMPTIONS, MEANING THEY'RE TOTALLY EXEMPTED FROM THE ORDINANCE.

AND THAT'S THREE THINGS RELIGIOUS ORGANIZATIONS AND THE STATE AND FEDERAL GOVERNMENT, BECAUSE THE CITY CANNOT GOVERN WHAT THE STATE OR FEDERAL GOVERNMENT DOES.

ALSO, THE STATE OF TEXAS HAS A LAW CALLED THE TEXAS RELIGIOUS FREEDOM AND RESTORATION ACT, WHICH PROHIBITS ANY GOVERNMENT FROM INFRINGING UNDER TEXAS STATE LAW, INFRINGING ON INDIVIDUAL RELIGIOUS FREEDOMS. SO IF SOMEBODY CLAIMS THAT YOU.

INFRINGED UPON MY ABILITY TO PRACTICE MY RELIGION.

THEY MIGHT CLAIM THAT AS A DEFENSE DEFENSE FROM THE CITY'S NBA.

SO THEY MIGHT BE EXEMPTED IF WE ARE BURDENING THEIR PRACTICE OF RELIGION.

I JUST WANT TO POINT THAT OUT AS WELL, EVEN THOUGH IT'S NOT SPECIFICALLY MENTIONED IN THE ORDINANCE THAT IS IN TEXAS STATE LAW.

AND THEN IN ADDITION TO THE BROAD EXEMPTIONS, THERE ARE SOME SPECIFIC ONES.

AND THESE ARE THINGS THAT YOU'RE GOING TO FIND IN FEDERAL AND STATE LAW AS WELL.

SOME EXEMPTIONS FOR SMALL EMPLOYERS, SMALL LANDLORDS, AND IF IT'S A PRIVATE ORGANIZATION, MEANING IT'S NOT OPEN TO ANY MEMBERS OF THE PUBLIC.

SO WHAT WOULD BE THE PROCESS IF SOMEONE FEELS THAT THEY HAVE BEEN DISCRIMINATED AGAINST IN VIOLATION OF THE ORDINANCE? WHAT WOULD THEY DO IN THE CITY? THEY CAN FILE A COMPLAINT.

THEY NEED TO MAKE THAT COMPLAINT WITHIN 90 CALENDAR DAYS FROM WHEN THE ALLEGED VIOLATION OCCURRED.

AND THEY'LL MAKE IT ON A FORM THAT WE'RE CURRENTLY DEVELOPING THAT WILL BE SUBMITTED TO CITY STAFF, CITY STAFF AT TEN BUSINESS DAYS, THEN TO DECIDE WHAT WE'RE GOING TO DO WITH THE COMPLAINT, IF WE CAN REFER IT TO A FEDERAL OR STATE AGENCY, WE'RE GOING TO AUTOMATICALLY DO THAT.

IF WE CANNOT, WE'LL ACCEPT THE COMPLAINT LOCALLY FOR FURTHER INVESTIGATION.

WE ALSO MAY DENY IT IF IT JUST DOES NOT MEET THE BASIC ELEMENTS OF THE ORDINANCE SUCH AS MAY HAVE HAPPENED IN THE CITY OF CORINTH.

WE CAN'T HANDLE THAT OUTSIDE OF OUR JURISDICTION.

SO AS I MENTIONED, WHERE WE CAN WE'RE GOING TO REFER TO THE APPROPRIATE FEDERAL OR STATE AGENCY.

SO RIGHT NOW, ANYTHING UNDER EMPLOYMENT AND HOUSING CAN BE REFERRED TO THE APPROPRIATE FEDERAL OR STATE AGENCY.

IT CAN GO TO THE EQUAL EMPLOYMENT OPPORTUNITY COMMISSION OR THE TEXAS WORKFORCE COMMISSION FOR EMPLOYMENT OR HOUSING.

IT CAN GO TO HUD, THE HOUSING AND URBAN DEVELOPMENT, AND THEN FOR PUBLIC ACCOMMODATIONS.

SOME MAY BE ABLE TO GO TO THE JUSTICE DEPARTMENT, DEPENDING ON THE PROTECTED CLASS, BUT SOME MAY NOT BE ABLE TO.

MEANING THERE'S NOT A FEDERAL LAW THAT EXISTS.

SO ON THE BASIS OF RACE, COLOR, RELIGION, NATIONAL ORIGIN OR ON DISABILITIES, WE MAY BE ABLE TO REFER THOSE TO THE JUSTICE DEPARTMENT.

ANYTHING ELSE? SEXUAL ORIENTATION, GENDER IDENTITY.

IF IT'S IN PUBLIC ACCOMMODATIONS, WE WOULD HANDLE THAT LOCALLY THROUGH A LOCAL PROCESS VIA ORDINANCE.

AND THIS IS WHAT THAT LOOKS LIKE.

WE TRIED TO MAP IT OUT AS MUCH AS WE CAN, BUT I'M GOING TO TRY TO DO IT VERY HIGH LEVEL.

SO THAT FIRST THAT FIRST SECTION IS WHAT I JUST TALKED THROUGH, HOW YOU'D FILE A COMPLAINT.

WE'RE DOING THE PRELIMINARY REVIEW, IF WE CAN REFER IT.

WE WILL. IF WE CANNOT, THEN IT REALLY GOES INTO THE REST OF THE PROCESS.

WE WOULD PROCEED TO DOING AN INVESTIGATION.

WE'LL TRY TO CONCILIATE THAT WHERE WE CAN ENTER INTO AN AGREEMENT.

IF WE CANNOT, IT'S POSSIBLE THAT IT COULD BE REFERRED TO THE MUNICIPAL PROSECUTOR FOR REVIEW FOR THE ENFORCEMENT STEP.

THERE IS A PENALTY IF YOU VIOLATE THE ORDINANCE IN DISCRIMINATING AGAINST SOMEONE FOR A CLASS C MISDEMEANOR, WHICH IS NO MORE THAN A $500 FINE.

BUT WE HAVE TO BE ABLE TO PROSECUTE THAT IN MUNICIPAL COURT.

AND THIS IS ONE OF THE CHALLENGES THAT WE'RE KIND OF DESCRIBING, THE CITY COUNCIL THAT HAS TO MEET CERTAIN THRESHOLDS IN ORDER TO MOVE FORWARD TO THAT MUNICIPAL PROSECUTION

STAGE. YOU HAVE TO HAVE CERTAIN LEVEL OF STANDARD THAT THAT IT OCCURRED.

I'M NOT SAYING THAT THE BEST, BUT IT DOES HAVE TO MEET CERTAIN STANDARDS IN ORDER TO MOVE FORWARD WITH THAT.

I JUST KIND OF TALKED THROUGH THAT.

IT MAY BE AT THAT TIME THAT THEY CLAIM THAT LAW IS A DEFENSE, AND THAT'S WHEN WE WORK WITH OUR OUR LEGAL TEAM TO REVIEW THAT.

WE DO ASK THAT THESE SPECIAL PERMITS BE SUBMITTED 60 DAYS IN ADVANCE, AND THAT'S WHAT WE HAVE ENOUGH TIME TO MAKE SURE IT MEETS ALL OF THE CRITERIA AND MAKE SURE IT'S SAFE FOR THE PUBLIC.

AND THEN IF IT'S IF IT REQUESTS COUNCIL APPROVAL, WE DO ASK THAT IT'S 90 DAYS AND THAT CAN INCLUDE REQUESTING A NOISE VARIANCE.

IT CAN ALSO INCLUDE CO-SPONSORSHIP OR SELLING OR PROVIDING ALCOHOL ON CITY PROPERTY.

SO ALL OF THOSE REPRESENTATIVES FROM THOSE DIVISIONS AND DEPARTMENTS TAKE A LOOK AT THAT 14 PAGE APPLICATION AND KIND OF GO THROUGH IT AND COMB IT OVER TO SEE WHAT CHANGES NEED TO BE MADE, HOW WE CAN MAKE IT SAFER, HOW WE CAN MAKE IT BETTER FOR THE COMMUNITY.

SO IT'S OUR JULY JUBILEE AND LIBERTY RUN.

SO IT'S ACTUALLY A THREE PART EVENT KIND OF ALL WRAPPED UP INTO ONE DAY.

SO THIS ONE'S ON JULY 2ND OF THIS YEAR, AND WE'RE GOING TO HAVE OUR 24TH ANNUAL LIBERTY RUN OUT AT THE CIVIC CENTER THROUGH GW AND QUAKERTOWN.

AND THEN WE FOLLOW THAT WITH THE YANKEE DOODLE PARADE THAT'S DOWNTOWN IN THE SQUARE, AND IT ENDS AT THE CIVIC CENTER.

AND THEN WE'LL HAVE OUR JULY JUBILEE FESTIVAL THAT'S AT THE CIVIC CENTER AND QUAKERTOWN PARK.

AND THEN OUR NEXT BIGGEST EVENT THAT WE HAVE WILL BE IN 2023.

AND THAT'S OUR GREAT AMERICAN CLEANUP.

THAT WAS ORIGINALLY HOSTED BY KEEP IT BEAUTIFUL.

AND NOW THAT WE'VE COMBINED TO BE JUST WITH THE CITY OF DENTON, WE'VE TAKEN OVER THAT EVENT.

AND SO WE'VE HAD I THINK LAST YEAR WE HAD OVER 1000 VOLUNTEERS COME IN DIFFERENT AREAS OF THE CITY TO CLEAN UP TRASH.

AND I THINK WE RECYCLED AND PICKED UP FOUR TONS OF TRASH OFF THE STREETS AND OUT OF OUR PARK SYSTEM.

SO THAT WAS REALLY EXCITING.

AND THEN WE HAVE OUR EASTER EXTRAVAGANZA.

THAT'S IN APRIL.

WE HAVE AGES 0 TO 10 THAT THEY CAN COME INTO THE PARK DOING EASTER EGG HUNT AND HAVE A GOOD TIME WITH THE EASTER BUNNY.

THERE'S DIFFERENT CRAFTS, FACE PAINTING, FOOD, ALL THE SORTS.

AND THEN LASTLY, OUR LAST LARGEST EVENT IS THE DENTON REDBUD FESTIVAL, AND THAT REALLY FOCUSES ON RECYCLING, REUSING, REDUCING AND REUSING ALL OF OUR RESOURCES. SO WE HAVE A REALLY COOL RECYCLING FASHION SHOW WHERE PEOPLE GET TO ENTER AND CREATE DIFFERENT NEAT OUTFITS.

IT'S REALLY, REALLY FASCINATING TO WATCH.

SO THOSE ARE OUR FOUR BIG EVENTS THAT WE HAVE, THE LARGEST ATTENDEES, BUT ALSO THAT WE HAVE OUR LARGEST FOOTPRINT.

YEAH. SO THEN ALSO WE DO HAVE SOME SMALLER EVENTS THAT DO NOT MAKE IT ONTO THE SLIDE.

AND THEN NORTH OF THAT WE WOULD PROVIDE SOME STRIPING IMPROVEMENTS THAT WOULD HELP IMPROVE OPERATIONS ON THE STREET, POTENTIALLY ADD SOME PARKING THAT WOULD HELP ACCOMMODATE PARKING DEMANDS AROUND THE PARK.

SO THERE'S SOME GOOD OPPORTUNITIES THERE.

A COUPLE OF GOALS I WANT TO HIGHLIGHT IS TO IMPROVE MULTIMODAL ACCESS.

CLEARLY, WE WANT TO MAKE SURE THAT PEOPLE CAN GET AROUND THE CITY SAFELY AND WE'RE LOOKING AT WHAT BIKE AND ACCOMMODATIONS ARE PROVIDED IN THIS CORRIDOR AND WE'RE LOOKING AT EVERY CORRIDOR AROUND THE CITY.

BUT IN THIS CASE, SPECIFICALLY HERE, THERE IS THE BENEFIT THAT THIS PROJECT WILL WILL ALSO PROVIDE IMPROVED ACCESSIBILITY TO THE PARK.

IT HELPS ADVANCE OUR TEN MINUTE WALK INITIATIVE THAT THE PARKS DEPARTMENT HAS IN THE CITY.

AND THEN WHAT I'M HERE TO TALK WITH YOU GUYS ABOUT TODAY IS THAT THIS IS A QUICK BUILD PROJECT, SOMETHING THAT WE GO OUT AND DO, USE VERY INEXPENSIVE, FLEXIBLE MATERIALS TO INSTALL IT, AND THEN WE GET A REALLY QUICK PROJECT.

ON THE SOUTH SIDE, WE HAVE SOME ADA CONSTRAINT ISSUES IN THAT AREA.

SO THE THE BIPED ENVIRONMENT IN THIS AREA IS NOT REALLY GREAT, BUT THIS PROJECT WILL PROVIDE CONTINUOUS ACCOMMODATION FROM CAROL UP TO THAT, UP TO THAT POINT AT CONVERSE STREET WHERE WE'LL TIE IN WITH THE TRAIL NETWORK AND THERE'S GOOD SIDEWALK CONNECTIVITY NORTH OF THERE.

SO WHEN YOU HEAR THAT BIKE, A LOT OF TIMES FOLKS FOCUS ON THE BIKE ASPECT OF MY JOB AND IT'S ALWAYS, HOW DO WE GET BIKE FACILITIES ON THE GROUND? BUT WE'RE LOOKING AT PROJECTS HOLISTICALLY.

HOW ARE WE GOING TO ACCOMMODATE ALL MODES? THE BIG QUESTION THAT I LIKE TO RAISE WITH FOLKS A LOT IS IF YOU PROVIDE A BIKE LANE ON A STREET THAT DOESN'T HAVE A SIDEWALK, IS IT TRULY A BIKE LANE? AND THE ANSWER IS NO, BECAUSE IF IN THE ABSENCE OF A SIDEWALK, THE STREET ACCOMMODATES PEDESTRIANS AS WELL.

SO JUST A LITTLE IRONY TO TO HIGHLIGHT THERE THAT WHEN WE PROVIDE BIKE LANES, THEY NEED TO ACCOMMODATE PEDESTRIANS IF THERE ARE NOT SIDEWALKS ON THE STREET.

THAT'S A REALLY GOOD EXAMPLE OF WHERE THIS SORT OF DESIGN PHILOSOPHY HAS BEEN SUCCESSFULLY USED IS THE BIG JUMP.

PEOPLE FOR BIKES HAVE HAD A GRANT PROGRAM WHERE THEY WOULD AWARD SOME SMALL FUNDING TO DO THESE SORTS OF TACTICAL PROJECTS AROUND AT DIFFERENT CITIES IN THE US. IN THIS CASE, THE IMAGES FROM A PROJECT IN BALTIMORE, MARYLAND, BECAUSE THIS WAS TIED IN WITH A CONSTRUCTION PROJECT, SO THEY CLOSED THE LANE WITH PORTABLE BARRIERS.

THEY NEEDED TO CLOSE THE LANE FOR CONSTRUCTION, BUT THEY WERE ABLE TO USE THAT SPACE TO ACCOMMODATE BICYCLES, PEDESTRIANS IN A ROAD THAT JUST WASN'T VERY ACCOMMODATING.

SO IT'S A VERY SUCCESSFUL APPROACH TO ALLOW PEOPLE TO TRAVEL ALONG THE ROADS LIKE THIS RIGHT HERE.

EXCELLENT. SO TO GIVE YOU AN IDEA OF WHAT THE DESIGN IS, THIS IS TAKEN RIGHT AT THE LIBRARY.

SO THE EXISTING IS TWO LANES IN EACH DIRECTION OR A FOUR LANE UNDIVIDED STREET NEXT.

I'M CALLING IT, I BELIEVE, AN ON STREET SHARED PATH BECAUSE IT'S REALLY A MULTI USE FACILITY FOR BICYCLISTS OR PEDESTRIANS.

WE WOULD REPURPOSE ANOTHER LANE FOR A TWO WAY LEFT TURN LANE THAT ALLOWS FOLKS WHO ARE DRIVING TO PULL OUT OF THE THROUGH LANE TO TURN LEFT.

ANYBODY WHO IS TURNING RIGHT WOULD BE DOING THAT AT A LOW SPEED.

THEY PRETTY MUCH CONTINUE TO MOVE AND THEN MAINTAINING ONE LANE IN EACH DIRECTION.

SO WE REALLY GET A GOOD BALANCE OF THE TRAFFIC OPERATIONS BY REPURPOSING THOSE LANES.

FROM AN ACCESSIBILITY PERSPECTIVE, I WANTED TO HIGHLIGHT SOME OF THE BEST PRACTICES IN THIS AREA COME OUT OF A RELATIVELY RECENT FEDERAL HIGHWAY'S PUBLICATION, THE ACCESSIBLE SHARED STREETS GUIDE.

SO THE FIRST OF THOSE ELEMENTS IS REALLY CHALLENGING WHEN YOU'RE IN AN ON STREET ENVIRONMENT BECAUSE TO PROVIDE A CONTINUOUS BARRIER, IT'S TYPICALLY WE WOULD WANT TO PROVIDE SOMETHING LIKE A PRECAST CONCRETE, CONTINUOUS ELEMENT IN THE STREET THAT IMPACTS DRAINAGE.

IT'S VERY COSTLY, IT'S VERY COST PROHIBITIVE.

IT WOULD TAKE TIME TO PROCURE AND DESIGN AND FABRICATE THOSE MATERIALS.

SO IN THIS CASE, WE'RE PROPOSING TO USE A RUMBLE STRIP.

AND A RUMBLE STRIP IS BASICALLY A PAVEMENT MARKING MATERIAL.

YOU PUT A SECOND PIECE OF THE MATERIAL ON TOPIC IS AN EXTRA DEPTH.

SO THAT EXTRA DEPTH IN THEORY SHOULD BE DETECTABLE BY A CANE.

A A PERSON USING A CANE CAN DETECT CHANGES IN THE SURFACE MATERIAL.

SO HAVING THAT DETECTABLE EDGE CONTINUOUSLY ALONG THE PATH WILL AT LEAST PROVIDE SOME LEVEL OF DETECTION.

ANOTHER FEATURE THAT I WOULD LIKE TO TEST, BUT WE DON'T HAVE THE MATERIAL OR THE METHOD TO INSTALL IT IS WHAT'S CALLED AN INLAID PAVEMENT MARKING, WHERE YOU'D ACTUALLY GRIND OUT AND THEN PUT THE PAVEMENT MARKING INTO THE RECESSED AREA OF THE PAVEMENT.

WE WANT TO MAKE SURE THE DRIVERS ARE MORE AWARE OF THIS CROSSING LOCATIONS.

SO DISCOURAGE DRIVERS FROM PULLING IN A PARKING IN THE PATHWAY.

WE DON'T HAVE ACCESS TO THAT MATERIAL CURRENTLY, SO WE'RE LOOKING AT SEEING IF WE CAN GET A VENDOR FOR THAT MATERIAL.

THOSE GET VERY SLIPPERY.

THOSE CAN GET VERY SLIPPERY, ESPECIALLY WHEN THEY'RE A LITTLE BIT WET OR DAMP.

I ACTUALLY HAD A COLLEAGUE WHO WAS RIDING IN A CROSSWALK.

HE FELL DOWN, BROKE OUT TWO OF HIS TEETH AND HELD THE GROUND.

SO AN ALTERNATIVE TREATMENT THAT'S BEEN INVESTIGATED, THE RESEARCH SUGGESTS THAT HAD ACHIEVED SIMILAR VISIBILITY, CONSPICUOUS OPACITY SORT OF ENHANCEMENT AS A PARALLEL BAR OR BAR PAIR.

SO IT'S BASICALLY EIGHT INCH LINES WITH AN EIGHT INCH VOID IN BETWEEN.

SO THAT GIVES YOU MORE SURFACE AREA FOR TRACTION.

MY BIGGEST CONCERN RIGHT NOW WITH COLOR CONTRAST IS IF WE USE A RED OR TERRACOTTA THAT TACK A WARNING SURFACE AND ADJACENT TO THE BACK END COLOR ON THE CROSSWALK IF THERE WILL BE SUFFICIENT CONTRAST, LIKE SHOULD WE LEAVE A GAP BETWEEN THE DEDUCTIBLES AND THAT COLOR CONTRAST.

AND I THINK WHAT WE'LL PROBABLY DO IS DETECTABLE WARNING SURFACE LEAVE THE EXISTING PAVEMENT UNTIL WE GET TO THE FIRST SET OF PAVEMENT MARKINGS FOR THE CROSSWALK AND DO THE COLORS IN BETWEEN.

OKAY. THAT'S WHAT I WANT TO MAKE SURE IT'S DETECTABLE.

BUT I THINK THE PARALLEL BARS AND I'D BE INTERESTED IF ANYBODY HAS VISION EXPERTIZE IN THIS AREA, I WOULD THINK WITH THE PARALLEL BARS AND ALL THAT COLOR CONTRAST AND EVERYTHING, THAT THE WHOLE CROSSWALK WOULD SORT OF SUITABLY CONTRAST WITH THE SURROUNDING ENVIRONMENT.
