UNDER THE LAW. DEFAULT TERM OF OFFICE FOR MUNICIPAL COURT JUDGE.
PRESIDING JUDGE, AN ALTERNATE OR ASSOCIATE JUDGES IS TWO YEARS.
THE TEXAS CONSTITUTION PROVIDES THAT A CITY CAN ALLOW FOR A FOUR YEAR TERM.
THROUGH CHARTER ELECTION PROCESS.
I THOUGHT SINCE WE'RE IN THE DISCUSSION OF CHARTER REVIEW, NOW WOULD BE THE APPROPRIATE TIME TO BRING THIS UP TO SEE IF COUNCIL WAS IN FAVOR OF MOVING FROM A TWO YEAR TERM TO A FOUR YEAR TERM COULD BE SOMETHING AS SIMPLE AS A ADDITION TO CHARTER SECTION 603 THAT SAYS MUNICIPAL COURT JUDGES SHALL SERVE A TERM OF FOUR YEARS.
IF THAT IS MOVED FORWARD IN CHARTER ELECTION AND APPROVED BY VOTERS, THERE WOULD BE A SMALL CHANGE WE'D NEED TO MAKE IN THE CODE OF ORDINANCES THAT REFLECTS A TWO YEAR TERM IN THE CODE ITSELF.
JUST A QUICK LIST OF BENEFITS OF A LONGER TERM STABILITY FOR JUDGES, CONTINUITY FOR STAFF AND COMMUNITY, ABILITY TO PLAN FOR LONGER TERM PROJECTS, AND THEN ENHANCED JUDICIAL INDEPENDENCE.

SO THERE'S ESSENTIALLY THERE'S MUCH LONGER TURNOVERS THAN, THAN THE TERM OF OFFICE.

JUST AS A TECHNICAL POINT, I WANT TO HIGHLIGHT THE LANGUAGE USED SURROUNDING THE CONVERSATION.
THIS IS A DISCUSSION OF A TABULATION OF DATA, NOT THE OFFICIAL RECORD OF THE CITY COUNCIL MEMBER VOTES, AS THE CHARTER REQUIRES THAT THE OFFICIAL RECORD BE MAINTAINED IN THE MINUTES. THE PRACTICE WAS DISCONTINUED IN APRIL OF 2023 UPON THE ADVICE OF A HIGHLY REGARDED CONSULTANT ENGAGED BY THE CITY TO EVALUATE, PROCESS, AND UNDERSCORE BEST PRACTICES.

A DEEPER DIVE INTO THE VOTE HISTORY METRICS FOUND THAT SINCE APRIL 2018, THERE WERE 244 CLICKS ON THE INDIVIDUAL COUNCIL MEMBER VOTE.
THE APRIL 20TH APRIL 4TH, 2023 MEETING WAS AN OUTLIER THAT PRODUCED A HIGHER VOLUME OF CLICKS 95 TO BE EXACT, AND WHEN THAT MEETING IS REMOVED FROM THE EQUATION, IT LEAVES 149 CLICKS OVER A SIX YEAR SPAN THAT AVERAGES ABOUT 25 CLICKS PER YEAR.

THE FIRST TAX ABATEMENT POLICY WAS APPROVED IN 1989.
GREEN INITIATIVES WERE ADDED TO THE POLICY IN 2010 AND AGAIN IN 2012.
POLICY WAS BROADENED TO APPLY TO CHAPTER 380 AND IMPLEMENT A WIDER RANGE OF PROGRAMS IN 2014.
RETAIL WAS ADDRESSED, SOME SALES TAX DEFINITIONS WERE ADDED, AND THE INVESTMENT FUND AND AIRCRAFT INCENTIVE PROGRAMS WERE INCORPORATED UNDER ONE UMBRELLA POLICY IN 2018. UP UPDATE IN 2020 HAD NO SIGNIFICANT CHANGES AS WE WERE WORKING ON OUR STRATEGIC PLAN, WHICH WAS APPROVED IN FEBRUARY OF 2021. SO THE EIGHT DISTRICTS IS CONTEMPLATING COLE RANCH AS WELL, WHICH IS ALSO AN MMD.

SO AFFORDABLE HOUSING INCREASE.
THE WE'VE ASKED FOR ADDITIONAL RIGHT OF WAY FOR A WASTEWATER PROJECT.
WE'VE ASKED FOR ADDITIONAL ACRES OF PRESERVATION AND THEN THEY'RE THEY'RE PROPOSING TO PLUG AND ABANDON TWO GAS WELL, PAD SITES AS WELL AS WE ASKED FOR A TIMING COMMITMENT FOR CONSTRUCTION TO BEGIN SPECIFIC TO THEIR PHASE ONE.
AND THEN OUR ROCK BRANCH PROJECT.
SO THIS IS THE PROJECT AGREEMENT.
SO INCREASING THAT FROM 120 ACRES TO 141 ACRES, WHICH IS 65% OF THE TOTAL 217 ACRES.
AND THEN PLUG AND ABANDON TWO GAS WELL PAD SITES NO LATER THAN MAY 31ST, 2027.
THERE ARE SEVERAL AMENDMENTS CONTEMPLATED.

THE OPERATING AGREEMENT ALSO INCLUDES AN AMENDMENT TO THE TAX RATE.
SO THE CURRENT AGREEMENT CONTEMPLATES THE MMD TAX RATE AT $0.55 PER $100 VALUATION.
THIS INCREASES TO A TOTAL OF $0.77.
AND THEN IT DOES ELIMINATE THE BOND REIMBURSEMENT CAP.
