SO IN GENERAL, LAND DEVELOPMENT IS THE PROCESS OF CHANGING THE CHARACTER OF A PORTION OF LAND SO THAT IT CAN BE USED FOR A NEW PURPOSE. LIKE MANY CITIES, DENTON REGULATES THE LAND DEVELOPMENT PROCESS TO ENSURE THAT LAND IS CHANGED IN ALIGNMENT WITH THE COMMUNITY'S PUBLIC HEALTH, SAFETY, AND WELFARE STANDARDS. DUE TO THE REGULATION OF THIS PROCESS, THE CITY REQUIRES A DEVELOPER TO SUBMIT AN APPLICATION ALONG WITH REQUIRED FEES, SHOWING HOW THE PROJECT ALIGNS WITH THESE STANDARDS. THIS AUDIT FOCUSED ON THE EFFECTIVENESS AND EFFICIENCY OF THE CITY'S DEVELOPMENT APPLICATION REVIEW PROCESS, WHICH IS GENERALLY FACILITATED BY THE CITY'S DEVELOPMENT SERVICES DEPARTMENT. ANNUALLY, THE CITY COLLECTS ABOUT $2 MILLION IN REVENUE FROM THIS PROCESS, AND SPECIFICALLY THIS AUDIT REVIEWED THE EFFICIENCY OF APPLICATION REVIEW PROCESSING AND THE EFFECTIVENESS OF DEVELOPMENT SERVICES, DEVELOPER AND COMMUNITY ENGAGEMENT ACTIVITIES. I JUST WANT TO TAKE A MOMENT TO ACKNOWLEDGE AN ALIGNMENT WITH THE CITY'S INCLUSIVE, CORE VALUE THAT THE LAND DEVELOPMENT PROCESS AND PARTICULARLY ZONING LAWS HAVE BEEN CONNECTED TO, RACIAL SEGREGATION IN COMMUNITIES HISTORICALLY. BUT DUE TO RESOURCE LIMITATIONS, THIS AUDIT WAS NOT ABLE TO EVALUATE THAT ISSUE DIRECTLY. BUT IF THAT'S SOMETHING COUNCIL WOULD LIKE US TO LOOK AT IN THE FUTURE, WE CAN DO SO FIRST, I'LL DISCUSS APPLICATION PROCESSING, TIMELINESS. THE DEVELOPMENT APPLICATION PROCESS ENSURES THAT PROJECTS ARE BUILT TO COMMUNITIES HEALTH, SAFETY AND WELFARE STANDARDS. BY REQUIRING A DEVELOPER TO GET APPROVAL FOR THEIR PLANS BEFORE BEGINNING CONSTRUCTION. IN GENERAL, THE DEVELOPMENT APPLICATION PROCESS OCCURS IN CYCLES AND DEPENDING ON THE PROJECT'S COMPLEXITY, COMPLEXITY CAN REQUIRE THE DEVELOPER TO SUBMIT THEIR APPLICATION PLANS AND OTHER SUPPORTING DOCUMENTS MULTIPLE TIMES BEFORE THE PROJECT IS APPROVED. BASED ON A COMPARISON OF THE CITY'S APPLICATION REVIEW. TIMELINESS TO BENCHMARK CITIES, WE FOUND THAT THE DEPARTMENT IS GENERALLY REVIEWING ALL DEVELOPMENT APPLICATIONS TIMELY. IN PARTICULAR, EACH REVIEW CYCLE TAKES ABOUT 13 DAYS ON AVERAGE, AND MOST APPLICATIONS ARE APPROVED. SORRY, 13 BUSINESS DAYS ON AVERAGE AND MOST APPLICATIONS ARE APPROVED OR DENIED AFTER THREE REVIEW CYCLES. IN GENERAL, AN APPLICATION TAKES ABOUT FOUR MONTHS FOR A DECISION TO BE REACHED, AND ABOUT 65% OF THIS TIME THE APPLICATION IS WITH THE DEVELOPER BEING REVISED BASED ON THE CITY'S COMMENTS. IN ADDITION, THE CITY HAS IMPLEMENTED STRATEGIES TO STREAMLINE THE REVIEW PROCESS, INCLUDING HAVING A SET SUBMITTAL SCHEDULE, PROVIDING APPLICATION SUBMISSION CHECKLISTS BY TYPE, OFFERING PRE APPLICATION AND IN-PROCESS MEETINGS, AND SETTING FEE SCHEDULES THAT ENSURE ACTUAL REVIEW COSTS ARE RECOVERED, STILL REDUCING THE NUMBER OF SUBMISSIONS IS THE MOST DIRECT WAY OF REDUCING THE TIME IT TAKES FOR A PROJECT TO GET APPROVAL. FOR THIS REASON, WE RECOMMENDED THE DEPARTMENT CONSIDER REQUIRING IN-PROCESS MEETINGS AFTER A CERTAIN NUMBER OF SUBMISSIONS HAVE OCCURRED TO HELP CLARIFY ANY ISSUES BASED ON THEIR MANAGEMENT RESPONSE. THE DEPARTMENT HAS IMPLEMENTED THIS PRACTICE AND HAS FORMALIZED IT IN AN SOP. IN RESPONSE TO THE AUDIT. FINALLY, BASED ON A REVIEW OF 92 APPLICATIONS, ALL BUT ONE HAD FEES APPROPRIATELY ASSESSED AND COLLECTED, WHICH RESULTED IN A TOTAL LOSS OF $101. IN ADDITION, THE DEPARTMENT OCCASIONALLY ISSUES REFUNDS, BUT THERE WAS NO SET CRITERIA FOR WHEN THESE SHOULD HAVE BEEN ISSUED UNTIL 2024. STILL, BASED ON REVIEW OF THE 2023 REFUNDS, WE FOUND THAT THEY WERE APPROPRIATELY APPROVED AND ALIGNED WITH THE NEW REFUND GUIDANCE. NEXT STATE LAW REQUIRES MUNICIPALITIES TO NOTIFY PROPERTY OWNERS ABOUT DEVELOPMENT PROJECTS WITHIN 200FT OF THEIR PROPERTY, AND BEST PRACTICES SUGGEST ENGAGING BOTH DEVELOPERS AND COMMUNITIES ABOUT DEVELOPMENT PROJECTS AND STANDARDS. WE FOUND THAT THE CITY GENERALLY OFFERS MORE ENGAGEMENT OPPORTUNITIES TO DEVELOPERS THAN BENCHMARK CITIES, INCLUDING HOLDING PERIODIC TOWN HALL MEETINGS WHERE THEY CAN PROVIDE FEEDBACK ON CODES AND PROVIDING A CUSTOMER SERVICE LINK TO PROVIDE FEEDBACK. WE DID FIND THAT SOME BENCHMARK CITIES POST PERIODICALLY UPDATED APPLICATION PROCESSING TIMES ON THEIR WEBSITE, WHICH DENTON IS NOT CURRENTLY DOING, SINCE DEVELOPERS BIGGEST CUSTOMER SERVICE FEEDBACK INVOLVES TIMELINESS, WE RECOMMENDED THAT THE DEPARTMENT CREATE A SIMILAR PROCESSING TIME DASHBOARD TO FURTHER COMMUNICATE TIMELINESS EXPECTATIONS WITH DEVELOPERS. IN ADDITION, THE CITY'S PUBLIC NOTIFICATION PRACTICES MEET AND EXCEED THE STATE'S MANDATES IN PARTICULAR, THE CITY NOT ONLY SENDS NOTIFICATIONS TO PROPERTY OWNERS WITHIN 200FT OF A DEVELOPMENT PROJECT, BUT ALSO SENDS NOTIFICATIONS TO RESIDENTS WITHIN 500FT OF THE PROJECT. ADDITION, THE CITY POSTS PHYSICAL SIGNAGE ON PROPERTY TO HELP NOTIFY INTERESTED RESIDENTS, HAS ONLINE MAPS SHOWING WHERE ACTIVE DEVELOPMENT PROJECTS ARE OCCURRING, AND ALLOWS RESIDENTS TO SIGN UP FOR NOTIFICATIONS IF THERE IS A DEVELOPMENT PROJECT NEAR THEIR PROPERTY. FURTHER, THE CITY'S CODE REQUIRES DEVELOPMENT SERVICES TO POST A NOTIFICATION OF DEVELOPMENT PROJECTS ON THE CITY'S WEBSITE, FURTHER INCREASING TRANSPARENCY. STILL, WE FOUND THAT THE INDUSTRY IS BEGINNING TO ADD QUICK READ OR QR CODES TO PHYSICALLY POSTED SIGNAGE TO THAT WOULD IMMEDIATELY DIRECTS A PERSON TO FEEDBACK OPPORTUNITIES FOR PROJECTS, HELPING TO INCREASE ACCESS. FOR THESE REASONS, WE RECOMMEND THE DEPARTMENT CONSIDER ADDING QR CODES TO ITS PHYSICAL SIGNAGE AND THAT CLEAR GUIDANCE ON REQUIRED WEBSITE POSTINGS, AND BASED ON THEIR MANAGEMENT RESPONSE, THE DEPARTMENT IS CURRENTLY WORKING WITH STRATEGIC SERVICES TO CREATE A DASHBOARD THAT WILL INCLUDE APPLICATION PROCESSING TIMELINES, AND THE DEPARTMENT'S PHYSICAL SIGNAGE GUIDANCE HAS BEEN UPDATED TO REQUIRE QR CODES. SO IN SUMMARY, WE ISSUED THREE RECOMMENDATIONS, ALL OF WHICH THE DEPARTMENT AGREED WITH. AND BASED ON THIS RESPONSE, WE BELIEVE THE IDENTIFIED RISKS, WHICH WERE VERY MINIMAL, WILL BE APPROPRIATELY ADDRESSED, AND SO I WOULD LIKE TO GET DIRECTION FROM COUNCIL IF YOU WOULD LIKE A FORMAL FOLLOW UP REVIEW WHERE I PRESENT THE RESULTS TO YOU ON THIS PROJECT, OR IF YOU'RE COMFORTABLE WITH JUST AN INFORMAL REVIEW THROUGH AN ISR.BUT OTHER THAN THAT, I CAN TAKE QUESTIONS. I MEANT THE LATTER. OKAY. WHEN YOU AUDITED THE DEVELOPMENT PROCESS, DID YOU AUDIT THE AMOUNT OF ENGAGEMENT WITH THE COMMUNITY THAT THE DEVELOPER AND STAFF ENGAGED IN WITH THE COMMUNITY? SO SORRY FOR ALL THE REDUNDANCY, BUT I JUST WANT TO MAKE IT CLEAR, YES, WE BASICALLY EVALUATED WHAT OUR, THE CITY'S ENGAGEMENT PRACTICES WERE COMPARED TO BEST BENCHMARK CITIES AND OTHER INDUSTRY STANDARDS. AND WE FOUND THAT GENERALLY, THE CITY WAS DOING WHAT EVERYBODY ELSE WAS DOING, IF NOT MORE. THAT ANSWER YOUR QUESTION. YEAH, I THINK IT DID. I NOT NOT SO MUCH FOR YOU, BUT FOR THE FOR THE STAFF IN GENERAL. IN MY TIME ON COUNCIL, I'VE SEEN THAT THE MORE WE HAVE IN COMMUNITY ENGAGEMENT, THE, THE HIGHER SUCCESS RATE OF PROJECT HAS EVEN IF IT DOES POTENTIALLY SLOW THINGS DOWN A LITTLE BIT. BUT WE WOULD NO LONGER RECEIVE ACCESS TO ANY OF THE INFORMATION GENERATED BY OTHER LAW ENFORCEMENT AGENCIES. ALSO, I WANTED TO REMIND OUR COMMUNITY THAT WE ARE STILL IN A I HAVEN'T SPOKEN ON THIS IN A WHILE, BUT WE'RE STILL IN A QUAKER TOWN. FUNDRAISING MODE.
