The 14.966-acre tract is located on the west side of private road Indian Wells Road and approximately 2,320 feet north of Gribble Springs Road in the Extraterritorial Jurisdiction Division 1 of the City of Denton, Denton County, Texas. >> GOOD EVENING. COMMISSION MATT BEAUDOIN, ASSISTANT PLANNER HERE TO PRESENT THE VARIANCE CALLED ZAPATA ADDITION SUBDIVISION VARIANCE. SO A LITTLE BIT OF BACKGROUND. THIS VARIANCE IS ASSOCIATED WITH A APPROXIMATELY 15 ACRE PROPERTY LOCATED IN THE ETJ ONE. IT'S ASSOCIATED WITH A PLAT THAT WAS JUST TO SUBDIVIDE THE PROPERTY INTO TWO LOTS FOR SINGLE FAMILY RESIDENCES, AND CURRENTLY TAKES EXCLUSIVE ACCESS FROM EXISTING PRIVATE ROAD. INDIAN WELLS ROAD.

SO THEIR SUBDIVISION REQUEST IS FROM A SECTION OF THE DDC SO THAT THEY CAN ALLOW MORE THAN THREE RESIDENTIAL LOTS TO TAKE ACCESS TO A PUBLIC STREET BY MEANS OF A PRIVATE ACCESS EASEMENT. SO I'LL GO THROUGH THE CONSIDERATIONS THAT STAFF TOOK INTO EFFECT WHEN LOOKING AT THIS VARIANCE. SO THE FIRST IN CONSIDERATION IS THAT THE VARIANCE WILL NOT BE DETRIMENTAL TO THE PUBLIC. STAFF FINDS THAT TO BE THE CASE FOR THIS VARIANCE. SECOND THAT THERE ARE PARTICULAR CONDITIONS IN PLACE THAT MAKE, I GUESS, APPEARING TO THE LAW DIFFICULT, THOSE BEING THE PECULIAR PATTERN OF DEVELOPMENT THAT'S BEEN IN PLACE IN THIS AREA, CREATING LOTS OFF OF PRIVATE ACCESS DRIVES, AND THAT THE EXISTING CONFIGURATION IS ALREADY OUT OF COMPLIANCE. THIRD, THAT BESIDES THIS VARIANCE, THE THE REST OF THE DEVELOPMENT CODE, AS WELL AS PLANS OF THE CITY ARE UPHELD. THIS IS THE ONLY MANNER OF THE DDC THAT THE REQUEST IS SEEKING VARIANCE FROM, AND ALSO PRESERVES RIGHT OF WAY RESERVATION AS OUTLINED ON THE MOBILITY PLAN. FOURTH, THAT THE CONDITIONS. THE UPON WHICH THIS REQUEST IS BASED WERE NOT A RESULT OF THE OWNER PRIOR TO THE DATE OF THE REQUIREMENT OF THE DDC. AND SO THIS ROAD, THIS PRIVATE ROAD AND THESE EXISTING TRACKS WERE ESTABLISHED ROUGHLY ABOUT 1982, SO WELL BEFORE THE 2019 DDC. WITH THAT IN MIND, STAFF IS RECOMMENDING APPROVAL
